During 2018, How many people classed as IC1/IC2 (combined) were arrested (charged or not) by officers of your force area for the following.

1. Breach of the peace
2. Hate Speech specifically against disability, race, religion, sexual orientation or transgender identity
3. Section 5 of the POA

and during 2018, how many people classed as IC6 were arrested (charged or not) by officers of your force area for the same

Dear Daniel Elliott,

I am writing with regards to your request for information, which was
received 16th June.

We have started to consider your request, however we require further
information before we are able to proceed.

Hertfordshire Constabulary do not centrally record offences of Hate
Speech. Please provide the home office codes that you wish us to make our
searches under.

As you will appreciate the statutory timescale for our response to your
request will not commence until we are supplied with the further
information which we require. In the event that we do not hear from you we
will assume that you do not wish to proceed with your request.

As I understand it, there is no specific offence of “Hate Speech”, so to clarify...

Any crime with a perceived hate element will have a prejudice marker (race, religion, disability, etc.) attached to the crime report; You would have information on all hate crimes recorded in 2018 with prejudice markers attached.

If you can supply this information broken down by offence and with the requested suspect ethnicities and by reporting on all offences, this should pick up any of the public order offences too.

This is the amendment suggested to me by other police forces who also said they don't record hate speech in the same way as yourselves and has been accepted as a reasonable amendment.
