There was a similar copyright issue on an earlier request (http://www.whatdotheyknow.com/request/on...) which eventually led to the ICO issuing a decision notice (http://www.ico.gov.uk/upload/documents/d...) saying "the public authority should provide the requested information to the complainant to the whatdotheyknow.com email address that was used to make the request". I would point this out to the QCDA if I were you!

I am writing to request an internal review of Qualifications and Curriculum Development Agency's handling of my FOI request 'CReSt final project report'.
You have not sent me the information I asked for, nor have you provided a valid refusal notice in line with the requirements of the Freedom of Information act.
As I have already pointed out to you, the Information Commissioner has already considered the same arguments you are now putting forward and has rejected them; your responsibility is simply to respond to the "address for correspondence" and any subsequent publication against your wishes would be a separate matter. Further to your email below, the formal confirmation of the outcome of
the internal review and the annotated document are now ready to be sent
to you. However when attempting to send these items I have received an
'undeliverable' message. This may because of the size of the report and
I have asked QCDA IT staff to look into this issue as a matter of
urgency. However it could also be because your mailbox is full so you
may like to check this in the meantime.
