There was a similar copyright issue on an earlier request (http://www.whatdotheyknow.com/request/on...) which eventually led to the ICO issuing a decision notice (http://www.ico.gov.uk/upload/documents/d...) saying "the public authority should provide the requested information to the complainant to the whatdotheyknow.com email address that was used to make the request". I would point this out to the QCDA if I were you!

I am writing to request an internal review of Qualifications and Curriculum Development Agency's handling of my FOI request 'CReSt final project report'.

You have not sent me the information I asked for, nor have you provided a valid refusal notice in line with the requirements of the Freedom of Information act.

As I have already pointed out to you, the Information Commissioner has already considered the same arguments you are now putting forward and has rejected them; your responsibility is simply to respond to the "address for correspondence" and any subsequent publication against your wishes would be a separate matter. the internal review and the annotated document are now ready to be sent
to you. However when attempting to send these items I have received an
'undeliverable' message. This may because of the size of the report and
I have asked QCDA IT staff to look into this issue as a matter of
urgency. However it could also be because your mailbox is full so you
may like to check this in the meantime.
