Thank you for your request received on 7 June 2022 concerning:

Around 8 minutes into (Former) Cllr Matthew Bennett's statement at the
Overview and Scrutiny Committee Meeting on 4 May 2020. He states that Mott
MacDonald's work is now done, it was done well and is now ours and forms
the next stage of work on Cressingham.

This was in relation to the commissioning of £875,000 of work by Lambeth
Council to take Cressingham Gardens to RIBA stage 1.

1. Please could I have a list of the documents that were delivered as part
of this work?
2. Which of those documents were used by LBL or HFL in follow up work on
Cressingham Gardens.
3. Can the documents that have been delivered be made public - if there is
commercial sensitivity please can you:
a. redact anything that is genuinely still commercially sensitive (bearing
in mind this request will be under EIR regulations.)
b. give a full explanations why, around 5 years on from their production,
these documents are still commercially sensitive?

We are now considering the request but we need more time to process it. 
This is because we are reviewing the documentation to ensure that any
relevant exemptions are applied in accordance with legislation.  We will
now try to respond to you by 3 August 2022.
 
If you are dissatisfied with the way in which your Environmental
Information Regulations request has been dealt with you can request an
internal review. Tell us why you are unhappy with our response within 40
working days, and it will be looked at afresh. We will aim to provide you
with our review response within 20 working days.

Council’s handling of your FOI request. 
 
You stated: 
 
I am writing to request an internal review of Lambeth Borough Council's
handling of my FOI request 'Cressingham Gardens RIBA stage 1 documents
delivered by Mott Macdonald'.
Whilst I am grateful that we finally have some confirmation that Mott
MacDonald did indeed deliver information to Lambeth Council for the
£875,000 that we spent for their services, I am concerned that a
significant amount of the report is redacted.
This information, which has been paid for by its residents should be of
significant use to Lambeth Council and its residents so I would like a
review of the redactions. On looking through the redactions, I don't think
there should be many issues with personal data in the report so please can
justifications be given for the redactions that have been made.
Also can Lambeth confirm that this report is the only deliverable from
Mott MacDonald for the £875,000 price tag?
 
Decision
 
I can confirm that we are of the view that some of the information within
the documents provided were withheld as we believe that it is exempt from
disclosure under Regulation 13: Personal Data and / or Regulation 12
(5)(e) Confidentiality of commercial or industrial information.

Regulation 13: Personal Data
We consider disclosure would breach the Data Protection Act 2018 and
therefore maintain that it was correct to engage Section 40(2): Personal
Data to elements of this request.

It was correct to consider whether it would be fair to disclose names of
personnel / images of people, including whether disclosure would cause any
unnecessary or unjustified damage or distress to the individual concerned;
the individual’s reasonable expectations of what would happen to their
information; and balancing the rights and
freedoms of the data subject with legitimate interests.

In this case, I can confirm that it would not be fair to the individuals
to disclose their information and / or images as it could cause distress
to the individuals.

We do not consider that the individuals would expect the Council to
disclose any information which may allow them to be identified. Although I
acknowledge the legitimate interest in disclosing general information
relating to Cressingham Gardens, I do not consider the legitimate interest
overrides the rights and freedoms of the
individual on this occasion

It was also correct to cite Regulation 12 (5)(e) Confidentiality of
commercial or industrial information.
12.—(5)
For the purposes of paragraph (1)(a), a public authority may refuse to
disclose information to the extent that its disclosure would adversely
affect—
(e) the confidentiality of commercial or industrial information where such
confidentiality is provided by law to protect a legitimate economic
interest
As this request relates to Environmental Information; we have also
considered the public interest in disclosure/maintaining the exception.
Public Interest in Disclosure
We note Regulation 12(2) EIR has a presumption of disclosure. We also
consider that disclosure would increase the public’s understanding of this
issue and we note the general benefit in transparency where possible.
 
Public Interest in maintaining the exception
· Negative effect on competitiveness if competitors were to have access to
information;
· Need to obtain value for money.
· It is not in the public interest to provide commercially and / or
economically sensitive information if it would mean that the Council
cannot provide advice in confidence.
 
We believe that the public interest in withholding the redacted
information outweighs the public interest in disclosure of the requested
information.

Regulations(EIR), this communication acts a Refusal Notice for elements of
your request
