Response to this request is long overdue. By law, under all circumstances, Essex Police should have responded by now (details). You can complain by requesting an internal review.

Dear Essex Police,

I am writing to you to request information on,

a Details of any kind of credit, charge, debit, corporate credit, fuel cards/accounts issued to Chief officer team, Chief Constable, Deputy Chief Constable (temporary Deputy Chief Constable), Assistant Chief Constables and also head of professional standards.

b Details of the type of cards and maximum spending limits on each card and for each member of staff.

c The name and job title of staff member that signs at end of each month confirming that they are satisfied that spending was exclusively for work and not personal use.

Please provide copies of all statements for all cards/accounts for the last 36 months.

Under the Freedom of Information Act we are required to reply within 20 working days. The Act does not specify a limit to the number of information requests a public authority may receive or the number of requests or questions an applicant may submit. However, there are exemptions in the Act that can apply and these include where the cost of complying with the request would extend beyond the reasonable cost limit, (currently 18 hours or £450), or if the request is otherwise manifestly unreasonable in its scope or nature.

Requests that ask a great many questions, or a number of detailed requests submitted at the same time, may make it necessary for Essex Police to refuse the requests wholly or in part. The exemption at s14 may be engaged if the burden on the authority is increased through multiple requests on differing subjects

When responding to a request for information under the terms of the
Freedom of Information Act, a public authority is not obliged to provide
information if the authority estimates that the cost of the retrieval of
the information requested would be in excess of £450 (equivalent to 18
hours work). The costs criteria relates to a request in its entirety,
which means that if we cannot retrieve all of the information requested
within the costs limit, we are not obliged to retrieve any of the
information requested.

 

In terms of Freedom of Information, I am afraid that the specific
information you were seeking access to is not held by Essex Police in what
is referred to as in a readily accessible format. The copy statement
requested are mainly held in paper form, and in Essex Police’s archive
store. Retrieval would involve a manual retrieval process.

For the purposes of section 17 (5) of the Freedom of Information Act 2000
(FOIA) this response serves as a formal notification of refusal of your
request on the basis that Essex Police does not hold, for the purposes of
FOIA, the specific data in a readily accessible format. That is to say,
this data is not extractable from a central database or held in a
spreadsheet. To extract the information requested would entail a manual
search of Essex Police records; a process which would be likely to exceed
the appropriate limit (as mentioned at section 12 of the FOIA) in terms of
cost/time (£450 or the equivalent in time of 18 hours).

Section 12(1) of the Freedom of Information Act states that a public
authority is not obliged to:

“…comply with a request for information if the authority estimates that
the cost of complying with the request would exceed the appropriate
limit.”

 

Having said that, and in an effort to assist - Although excess cost
removes the forces obligations under the Freedom of Information Act, I
have supplied information, relative to your request, which is already
easily retrievable. I trust this is helpful, but it does not affect our
legal right to rely on the fees regulations for the remainder of your
request.

Expenditure is countersigned by their respective Staff Officers prior to
processing by our Finance Department.

 

Details of any credit card transaction exceeding £500.00 is disclosed on
the PCC website as part of our disclosure of invoice payments exceeding
£500.00. This is reported quarterly. However only the supplier details are
disclosed, not the card holder and again only if it does not relate to
covert expenses etc.

As you will be aware the Information Commissioner's guidance for internal reviews held under section 50 of the Act is that they should be completed within twenty working days of receipt of the complaint, unless exceptional circumstances arise in which case the authority may extend the deadline by a further twenty days, this gives a deadline of the 20/07/16.
