Crawley Borough Council Tax - Prescribed Insolvency Forms used for Bankruptcy

Please confirm under the FOIA which prescribed Insolvency forms the council uses when bankrupting individuals for non-payment of council tax.

Prescribed Insolvency form 6.1 Statutory Demand under section 268(1)(a) of the Insolvency Act 1986 Debt for Liquidated Sum Payable Immediately and the corresponding prescribed form 6.7 Creditor's Bankruptcy Petition on failure to comply with a statutory demand for a liquidated sum payable immediately.

OR

Prescribed Insolvency Form 6.2 Statutory Demand under section 268(1)(a) of the Insolvency Act 1986 Debt for Liquidated Sum Payable Immediately Following a Judgment or Order of the Court and corresponding prescribed form 6.9 Creditor's Bankruptcy Petition Where Execution or Other Process on a Judgment has been Returned in Whole or Part.

Crawley Borough Council have failed to provide clarification as to whether or not you have ever bankrupted any individual for non-payment of council tax.

I have been asked to carry out a review on this FOI, my response to the
review is set out below :-

 

“ The Council received the following FOI request from you

 

Crawley  Borough Council Tax - Prescribed Insolvency Forms used for
Bankruptcy

 

Please confirm under the FOIA which prescribed Insolvency forms the
council uses when bankrupting individuals for non-payment of council tax.

The Council’s response is set out below :-

 

Crawley Borough Council has not bankrupted anyone in recent years in
respect of council tax.

 

You submitted a supplementary question to your initial FOI asking if the
Council had ever bankrupted anyone using the prescribed insolvency forms.

 

The Council’s response to this supplementary question was that many years
ago The Council undertook some bankruptcy work but we could not confirm
what forms were used.

 

You have requested a review of how the Council has handled your FOI in
that the Council has failed to provide clarification as to whether or not
the Council had ever bankrupted any individual for Council tax.

 

I have carried out a review of this FOI which is not up held for the
following reasons, as a public authority the Council is under a duty to
disclose information that they hold, The Council does not currently hold
written information in respect of bankruptcy proceedings for non-payment
of Council tax.

 

If you are not satisfied with the outcome of this Review you can appeal to
the Information Commissioner whose details are set out below :-
