This was responded to - after you took additonal time to redact some information claiming commercial confidentiality [although the redaction was not shown in the document]. However, I am still waiting for a response on the CPU update request.

You wil recall that this arises from a request for the minutes of the Board, that should have included these notes, but did not do so, as the update was just referred to, rather than being included inthe minutes [as is best practice].

Can you please send me the minutes of the last two meetings of the Board, electronically, please. However, I am looking for the minutes of any meeting where the CPU performance data is tabled, the last update published being in December 2015, and I understand that there have been subsequent presentations and meetings to discuss the CPU and NSL, and it is these that I am referring to.

Mrs Kelly responded to this request on 12 October and with a copy of the minutes and on 16 November with a copy of the CPU update. Unfortunately in her final response Mrs Kelly failed to advise you that with regards to the NSL update Nottinghamshire County Council does not hold this information. They are circulated in paper form at the time of the meeting but the Central Processing Unit do not retain copies of them anymore.

I am writing to request an internal review of Nottinghamshire County Council's handling of my FOI request 'CPU update separate notes referred to in the Notts Parking Partnership Board meeting 22nd July 2016'.

I find it most surprising that no officer took away, and filed, the paper copies of this material - given that it contained essential financial information for future budgetting and long term organisation appraisal. I would like a review of the documentation that officers took with them, as I cannot belive that no copies were taken away from the meeting and filed by NCC officers.

If no officer took away copies, this needs reviewing, as the information contained within these reports is esseential for understanding the operatiion of Parking Enforcemnt across the County.

I write further to your request for a review of your FOI request. You were
concerned that the Council did not hold the separate update prepared by
NSL and referred to in the minutes of the 22nd July 2016  Nottinghamshire
Parking Partnership Board. You find it surprising that no Council officer
took away  a copy of the notes.

 

I have conducted the review of the handling of your request, and made
further enquiries of the Enforcement Manager. I can confirm that the
Council does not hold this information (the NSL update). The update
contained detail on staffing numbers issue rates, health and safety
incidents, sickness etc. This detail would not need to be formally
recorded, or taken away by the Enforcement Manager,  as if he  needed any
aspect of it in the future he could  ask NSL for that detail. The Council
accepts that the minute taking here is not helpful, and in future the
minutes will reflect that NSL gave an update about company issues.

 

 If you are dissatisfied with this decision you may request the

Following my email below I can confirm that the previous meeting dates were 14-12-17 and before that March 21 2017 which I understand you have received the minutes for. A further meeting was held on 20 April 18 (minutes are still in draft format).

The Council have a Notts Board meeting scheduled for 30th November. Currently the Council have no dates scheduled for 2019 but recently we have been having 2 meetings a year.

I realise that this response is now being provided outside of the

I am advised that there has not been a meeting since November 2018. There
was due to be a Board Meeting this year but due to the pressures bought
about by the Council’s response to the COVID situation, this has not
happened.  I am also advised that the  accounts are not formally signed
off at the Board meetings, they are a discussion forum for operational
issues rather than a formal audit process.

The Board appears to have signed off its accounts - so there must have been meetings to do so. I am writing in response to your request for a review of your Freedom of
Information request.  Your FOI request of 5 November 2020 asked for:

 

Can you please effect this request, as the accounts from the Board need to
have been published by now and so there should, surely, have been a report
of the accounts at the Board. If not, please send me a copy of the
accounts for 2017-2018, 2018-2019, and 2019-2020.

 

The Council responded on  8 December 2020 stating:  I am advised that
there has not been a meeting since November 2018. There was due to be a
Board Meeting this year but due to the pressures bought about by the
Council’s response to the COVID situation, this has not happened. I am
also advised that the accounts are not formally signed off at the Board
meetings, they are a discussion forum for operational issues rather than a
formal audit process.   Please find attached The Notts Parking Partnership
combined accounts for the three years as requested.

 

On 12 December 2020, you asked for an internal review of Nottinghamshire
County Council's handling of my FOI requests 'CPU update separate notes
referred to in the Notts Parking Partnership Board meeting 22nd July
2016'.  You stated that there was a systemic failure to reply promptly and
fully to my requests and I am asking for this review to ensure that your
officers associated with the Notts Parking Partnership Board act fully in
compliance with the law. I am also requesting, that I still have not had,
the details of the last meeting of the Board that appears to have been
many months ago and information of the next and future meeting dates.

 

We had email communication on 17 December 2020 as I was seeking
clarification regarding what information you required reviewing as your
comment regarding Nottinghamshire County Council's handling of my FOI
requests 'CPU update separate notes referred to in the Notts Parking
Partnership Board meeting 22nd July 2016', was unclear and I required
confirmation as to what minutes were outstanding.   You confirmed, I have
sought the minutes of the last two meetings. The Board appears to have
signed off its accounts - so there must have been meetings to do so. Can
you please let me have a full list of the meetings that have taken place
so that the minutes of the meetings can be requested and seen?  Again, you
asked, Can your review also uncover why material has taken so long to
emerge, as there appears to be some difficulty in getting this information
into the public domain.

 

I can confirm that here has not been a meeting since November 2018. There
was due to be a Board Meeting in 2020 but due to the pressures bought
about by the Council’s response to the COVID situation, this did not
happen.

 

Below are the dates of our previous Boards:

The meeting of 26.04.2019 was a shareholders meeting for all partners
across all three Counties that use CPU for processing. The Board does not
and never has had a formal approving of our accounts, these are done by
our accountants at year end and then the final costs are disseminated to
the partners . It has been discussed at the Board but there is not a
formal process, basically it is only a ‘talking shop’ between the
enforcing authorities that discusses relatively minor issues of local
enforcement, contractual issues and back office performance. Leaving aside
the pandemic, these days we do it rather differently as there are not the
same number of creases to iron out after nearly 13 years operating, so
most discussions are done by either email or phone calls. There is nothing
in our S101 Agreement that dictates how often the Board should meet, it is
literally up to the Board when this happens and we are very much in a
phase of ‘as and when necessary’ now.

 

Before responding to your review I asked if it would be possible to do
discuss this with you to ensure that I had a full understanding of the
issues you were raising and what information was outstanding and what
material has taken so long to emerge.   I felt that email communication
between us was not clear or helpful to either of us, however, you declined
this and asked for me to communicate in writing.  Therefore, I apologise
if I have missed any outstanding issues you raised or not responded to you
as thoroughly as I had hoped to as part of this FOI review.

Dear Denise,

I have tried to call on the number given, but have not been able to speak. Can you please update me on the status of the Parking Enforcement Board. Does it still exist and if so who is the Chair? What is the date for the next meeting, please?

If not, can you please let me know which group oversees the Parking Enforcement issues between the NCC and the District and Borough Councils et al. and the enforcement company.

What was the distribution of receipts/costs over the last three years, please?

Apologies for the delay in responding, in answer to you specific questions;

1. Can you please update me on the status of the Parking Enforcement Board. Does it still exist and if so who is the Chair?

Yes it exists; the chair is Gareth Johnson (NCC Traffic Manager) although at the next meeting, that is likely to change.

2. What is the date for the next meeting, please?

There are no meetings scheduled yet in 2021. In the current circumstances these meetings are not regarded as a high priority.

3. What was the distribution of receipts/costs over the last three years, please?

This unfortunately will require more detail for us to answer. Information on the geographical areas and specifically which costs/income would assist in extracting the relevant data? I understand as part of your previous FOI requests you were provided with the profit and loss accounts up until 19/20, I am not sure if this is what you are referring to here, if not, please could you be more specific as to what you require.

Thank you - that is very helpful. I would be grateful if you or the Chair or his officers would let me know when the Chair calls a meeting.

The finances from the profit and loss accounts up until 19/20 were clear, and it is understood that the distribution of profit to the BC/DCs was as shown. When the figures for 2020/2021 are finalised I would be grateful if these are posted here too.
