Court listing clarification

Response to this request is long overdue. By law, under all circumstances, HM Courts and Tribunals Service should have responded by now (details). You can complain by requesting an internal review.

Dear Her Majesty’s Courts and the Tribunals Service,

I was one of eleven cases at Birkenhead Magistrates Court, court room four, on 17.02.15. You replied to my request FOI 104544 explaining you records show that three magistrates presided in court room four at the 09.45-13.00 session. This is not completely correct as my case was dealt with by DJ. M. Abelson.
Can you please tell me why the courts swapped the three magistrates for a District Judge for my case and why it is not officially recorded?
Also can you please tell me is it a common practice for the courts to swap Magistrates and Judges for a single case in the middle of a court session without the defendants knowledge? And if so under what circumstances would this happen?
In my request FOI 105646 you explained DJ. M. Abelson is officially recorded as being in court room seven on the 17.02.15 presiding over five or fewer cases.
Can you please tell me if he is officially recorded as being in court room seven how was he also in court room four and was he in court room four presiding over my case in his official judicial capacity?
Thank you for your time.
Yours faithfully,

Paul Parker

Dear Her Majesty’s Courts and the Tribunals Service,
Thank you for your reply via letter to my home address, however you have replied stating "further to your query" but I did not make a query I made an official F.O.I request and would appreciate you replying to it in accordance with section 11 of the act.
I would like to confirm I was not moved to see D.J Abelson in court room 7 because he "had finished earlier than allocated" what actually happened was mid session without my knowledge D.J Abelson replaced the three magistrates in court 4 to preside over my case then immediately after my case the three magistrates returned to the court to carry on with the rest of the cases listed for that session, and according to your reply to my earlier requests your records did not show this had been done or who had made this decision and why.
Also thank you for confirming D J Abelson adjudicated on this matter, but what I asked is was he acting in his official judicial capacity whilst presiding over my case?

Yours faithfully,

Paul Parker
