Dear Middle Level Commissioners,

Please treat this request for information as a request under the Freedom of Information Act 2000.

In recent correspondence about a consultation response, the Clerk and Chief Executive of the Middle Level Commissioners made the following assertion:

"the courts have already held that there is no right to moor at all, save as a proper incident to navigation, on the artificial cuts vested in the Commissioners".

Please provide me with the key documents, such as court judgments, that support the above assertion.

I would also be grateful if you would provide me with any documents in the possession of the Commissioners that provide a definition of mooring "as a proper incident to navigation".
