Court action against this Council
Dear Isle of Anglesey Council,
Could you please tell me how many people have taken legal action against this Council from March 2005 to December 2010. When I say legal action this could be in or out of court action that involved legal advisers or representation, could you please list these separate.
Could you list which department and out-line the main reason for complaint and the out-come if possible.
Yours faithfully,
J McTear

Dear Mr McTear,
Further to your FOI request dated 26.0.1.11 I would advise you that
following extensive enquiries, I have discovered that the authority
does not have one running list court action taken aganst the Council as
requested in your e-mail. The authority obviously does not require this
information to be kept in such a format and therefore, for the purpose
of S. 1 of the FOIA, the information you request is not “held”.
The FOIA provides a right of access to information held at the time a
request is made. The Act does not require research to be undertaken to
effectively create new information.
However, I have obtained a list of cases involving Insurance Claims
which may be of interest - these do not always lead to court proceedings
but the information is as follows:-
Education (inc Lifelong learning & Leisure): 6 successful; 15
unsuccessful; 6 on-going
Highways & Waste: 21 successful; 54 unsuccessful; 25 on-going
Housing (inc DLO): 10 successful; 12 unsuccessful; 10 on-going
Planning: 1 unsuccessful; 2 on-going
Social Services (inc PU): 6 successful; 2 unsuccessful; 3 on-going
Property: 1 successful; 5 unsuccessful; 3 on-going
If you are dissatisfied with any aspect of this response to your
request for information, and / or the decision made to withhold
information, you may ask for an internal review. Please address your
correspondence to the Customer Care Officer, Legal Services, Council
Offices, Llangefni, Ynys Môn LL77 7TW (E-mail:
[email address]).
If you are not content with the outcome of any internal review you have
the right to apply directly to the Information Commissioner, Wycliffe
House, Water Lane, Wilmslow SK9 5AF. Please note that the Information
Commissioner is likely to expect internal review procedures to have been
exhausted before beginning his investigation.
Regards,
Beryl Jones
