County Court Officers- Discretion regarding Insolvency Rule 6.10

Re: Insolvency Rules, 6.10

1) Insolvency Rule 6.10 states:

Procedure for presentation and filing

Rules 6.10

(4) The date and time of filing the petition shall be endorsed on the petition and on any copy issued under paragraph (3).

Please provide details of any internal procedures or manuals that would allow a Court Officer not to obey this Rule.

2) Please provide details of the numbers of Court Officers/employees of HM Courts and Tribunal Service who have been disciplined/ faced disciplinary charges from 1st January 2007 to date for failing to obey Rule 6.10 provisions on presentation of a bankruptcy petition to the Court.

3) Please provide details of the number of prosecutions and outcomes(if any) for breach of Rule 6.10 under the provisions of S.133 of the County Courts Act 1984.
