County court money claims centre and allocation of court
Dear Her Majesty's Courts and Tribunals Service,
Under the FOIA, I would like to know when a claim is brought before the County court money claims centre, for a sum of money and the CCMCC issues the claim to the claimant, under what circumstances can they decide on the county court which will hear the case?
Could you also kindly answer, under circumstances where the claimant resides in a different city in the United Kingdom i.e London but the case has been listed under another city court, i.e Swansea county court, what rights does the claimant have to change the court that handles the case and does the claimant have a right to refuse the case be handled in a different geographical area, different area of the country than the one in which they reside?
I look forward to hearing from you,
Yours faithfully,
Mrs Oppenheimer

Not in all cases it seems are cases allocated to the local court, it appears to depend on the lawyers and who they know within the court offices.
Virtually impossible to find out if you are within the right court before a judge with the correct authorisation to hear a particular case.
