Dear South East KILO,
Thank you for the link to the County Court record retention and deposition schedules which say that Charging Order files can not be destroyed until 3 years after the date of the last paper.
Yours sincerely,
J Hicks
Dear South East KILO,
Please recheck with the County Court Maidstone as to why they are allowed to break HMCTS /MOJ court record retention and deposition policy and to destroy Charging Order court files after 2 years instead of 3 years.
Yours sincerely,
J Hicks

Dear South East KILO,
In your first response you made it clear that the charging order files had been destroyed and not in-line with HMCTS/MOJ record retention policy. Provide the section of the policy you are relying on.
Please confirm if the charging order files for DJ Smith on 27 February 2014 have been destroyed.
Please confirm if the charging order files for DDJ Swales on 8 October 2014 have been destroyed.
Please clarify your response as to the actual number of charging order applications DJ Smith granted on 27 February2014.
Please clarify your response as to the actual number of charging orders DDJ Swales granted on 8 October 2014.
A vague figure of 5 or fewer is not acceptable.
Yours sincerely,
J Hicks
Dear Her Majesty’s Courts and the Tribunals Service,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Her Majesty’s Courts and the Tribunals Service's handling of my FOI request 'County Court Charging Orders'.
HMCTS have given vague answers and have failed to give a full answer.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...
Yours faithfully,
J Hicks
Dear Sir or Madam

Dear Reid , Scott,
There is no risk of any individual being identified and I don't believe your exemptions are valid.
So are you saying that the only way of receiving any transparency on information that must be held on your case management system including interim charging orders is through reporting this to the ICO, when your courts are destroying files ?
Yours sincerely,
J Hicks
