Our data are not organised in such a way as to allow us to provide this

Please note that researching each individual case would exceed the
appropriate limit (FOIA, s.12 (1)).

 

Therefore, the cost of compliance with your request is above the amount to
which we are legally required to respond, i.e. the cost of locating and
retrieving the information would exceed the appropriate costs limit under
section 12 of the Freedom of information Act 2000. For West Midlands

Dear West Midlands Police,

Please pass this on to the officer who conducts Freedom of Information reviews.

I am writing to request an internal review of West Midlands Police's handling of my FOI request 'Counter terrorism and monitoring of suspects'.

The grounds for complaint are as follows:

1. The complaint was finalised outside the statutory period, as set out at s10 of the Act. The 20 working day limit is very much a backstop in any event, the explicit requirement is for a public authority to respond PROMPTLY.

2. a. Under the College of Policing's Authorised Professional Practice (APP) the requirements at para 1 above are re-emphasised. However, they carry greater weight as the APP is embedded in the College's Code of Ethics.
b. The manner of finalisation of the instant request discloses two breaches of the Code: (i) Respect and Courtesy (ii) Neglect of Duty. Accordingly, it is required that conduct complaints be recorded against the Head of the Freedom of Information Unit within ten working days.
c. In the absence of a recording decision the mater will be escalated to the Independent Police Complaints Commission (IPCC) by way of a non-recording appeal.

3. The finalisation provided is non-compliant insofar as it does not contain a s17 refusal notice as required under the Act.

4. The finalisation provided is non-compliant insofar as it does not contain s16 assistance/guidance as required under the Act. The reasons given bear no scrutiny at all.

5. The reliance on the s12 overcost exemption is misconceived. If the information requested is not archived, and readily retrievable, then this would expose catastrophic failings of effectiveness and efficiency that the public requires of a well run police force.

6. The same request has been made to a number of other police forces. None of them has relied on s12 overcost as an exemption.

7. There is, of course, no right of review under the Act, but ICO Guidance recommends that public authorities under s45 establish a Code of Practice which includes reviewing request finalisations. In the case of West Midlands Police this is APP. I acknowledge your comments and grounds for internal review and will
address these separately for ease.

 

Point 1. I acknowledge that the request was not issued within the 20
working day deadline.  I apologise for the delay to the original response.

 

Point 2. In relation to the conduct of the Head of the information Unit,
as advised , I forwarded your complaint to our Professional Standards
department for them to deal with . They will provide a separate response
in relation to this.

 

Point 3 and 4 . I have reviewed the original decision you received and
within this letter, it did detail that the letter was a refusal and that
we would be unable to suggest a way to refine your request . therefore I
believe these obligations were met . 

 

In relation to your remaining points raised I have considered these when
reviewing the decision in relation to your request.

I have reviewed the original decision and can confirm that this would
exceed cost .Our data are not organised in such a way as to allow us to
provide this information and researching each individual case would exceed
the appropriate limit (FOIA, s.12 (1)) Records would need to be cross
reference across multiple systems  and place a burden on the force to
complete this .

Please re-consider the request as only concerning question 5.

 

5. The number of persons living in West Midlands policing area who have
been charged by the Metropolitan Police with counter-terrorism offences.

 

RESPONSE

 

Our data are not organised in such a way as to allow us to provide this
information and researching each individual record would exceed the
appropriate limit (FOIA, s.12 (1)) Records would need to be cross
reference across multiple systems.

 

Therefore, the cost of compliance with your request is above the amount to
which we are legally required to respond, i.e. the cost of locating and
retrieving the information would exceed the appropriate costs limit under
section 12 of the Freedom of information Act 2000. For West Midlands
Police, the appropriate limit is set at £450, as prescribed by the Freedom
of Information and Data Protection (Appropriate Limit and Fees)
Regulations 2004, S.I. 3244.

 

A public authority which, in relation to any request for information, is
relying on a claim that section 12 or section 14 applies must, within the
time for complying with Section 1(1), give the applicant a notice stating
that fact. In accordance with the Freedom of Information Act 2000, this
letter acts as a refusal notice.

 

As previously advised I am unable to suggest any practical way in which
your request may be modified; as any refinement could be accommodated
without a Neither Confirm or Deny response.
