Dear Ms Neal,

Thank you for your recent message, which I recieved today.

I understand the reasons for your decision, and do not wish to contest it by applying for an internal review. Nor shall I press for information about how the rate of 99 hours was calculated, interesting though this would be.

I would also like to thank you and Mr MacIntyte very much for providing the annex to your response. I consider this an excellent service to me as an applicant, and very much in-keeping with the spirit of the 2002 Act.

I would therefore like to make a fresh request for information, under section 8 of the Freedom of Information (Scotland) Act 2002, that is limited to the following sections of the Counter Fraud Services Manual to which Mr McIntyre referred:

2,3,4,11,14,16,17

Public interest justification for this request

I consider the public interest is strongly in favour of disclosing these elements of the Manual (with appropriate and proportionate redactions), as they appear to provide guidance to NHS CFS staff as to how to conduct their work within the confines of the law.

I have no desire to seek to undermine the work of CFS - work which is very clearly vitally in the public interest. Indeed, I consider the choice of sections shows this. But I believe that requesting the sections I have is reasonable, because disclosing this information would enhance public accountability, especially as no external reviews are publicly available about the efficiency of NHS CFS' work, and it is not subject to the jurisdiction of bodies that inspect investigatory organisations (such as HM Chief Inspector of Constabulary).

There are precedents for disclosure of this information - as I outlined in my previous email - in regard to the DWP. There, the public interest was considered to be in favour of disclosure with (arguably) an organisation of a similar nature.

Furthermore, while I acknowledge the redaction would be undertaken by senior investigative staff, and that this may have some impact upon CFS, neither Parliament or the Commissioner have decided that this should be a material consideration in deciding whether to disclose the information (save in terms of the calculation of fees), and the redaction would be an undertaking that need only be conducted once - especially as the released documents could be viewed publicly.

I hope these representations help when you come to your decision about disclosure under the Act. I have set them down now so as to make my submissions as clear as possible to you as early as possible - I hope this is of assistance.
