Dear Student Loans Company Limited,

I just want to know
1) How many students were deemed unfit by the student finance for the period between 2016/2018 because of fraud suspicious?

2) How many of these students escalated their cases in to the formal appeal stages, meaning how many students appealed against SLC counter fraud decisions ?

3) How many of these appeals were overturned in appeal stage 1?

4) How many of these appeals were overturned in appeal stage 2?

5) How many of these appeals were overturned by independent assessor, or in other words in the stage 3 of the formal appeal process?

Yours faithfully,

David Ostara

FOI Requests, Student Loans Company Limited

Dear Mr Ostara

I refer to your recent email dated 14/02/2018 requesting the following
information under the Freedom of Information Act 2000 (“FOIA”):

“I just want to know
1) How many students were deemed unfit by  the student finance for the
period between 2016/2018 because of fraud suspicious?

2) How many of these students escalated their cases in to the formal
appeal stages, meaning how many students appealed against SLC counter
fraud decisions?

3) How many of these appeals were overturned in appeal stage 1?

4) How many of these appeals were overturned in appeal stage 2?

5) How many of these appeals were overturned by independent assessor, or
in other words in the stage 3 of the formal appeal process?”
Clarification of the timeframe was requested, and by email dated
16/03/2018 you confirmed that you meant “the Academic Years between 2016
to 2018”.

Response
I can confirm that the Student Loans Company Limited (“SLC”) does not make
any students unfitted for student finance on the basis of fraud
suspicions.  Students are only made unfitted after a fraud investigation
has concluded and, depending on the specific circumstances, the level of
sanction imposed is unfitted for some or all support.

Question 1
4,040 students from academic years 2016/17 to 2017/18 (to date) have had
student funding removed or reduced as a result of a fraud investigation.

Question 2
Appeals data is available on a financial year basis.  Appeals are recorded
on the number which are processed each financial year, not in which
academic year they relate to as there is no time limit for appeals.

The table below confirms the number of unfitted appeals escalated and
handled by SLC’s Regulatory Support Team:

Financial Year Stage 1 Stage 2 Stage 3
2016-17 224 73 51
2017-18 (to date) 197 43 34

Please note that the 2017-18 figures are not finalised as the year is not
yet complete.

Question 3
12 2016-17 unfitted appeals were overturned at stage 1 of the appeals
process.

4 2017-18 unfitted appeals were overturned at stage 1 of the appeals
process (to date).

Question 4
2 2016-17 unfitted appeals were overturned at stage 2 of the appeals
process.

0 2017-18 unfitted appeals were overturned at stage 2 of the appeals
process (to date).

Question 5
9 2016-17 unfitted appeals were overturned by an Independent Assessor.

3 2017-18 unfitted appeals were overturned by an Independent Assessor (to
date).

Internal review process

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review.

Internal review requests should be submitted within two months of the date
of receipt of the response to your original request and should be
addressed to the Freedom of Information Office, Student Loans Company
Limited, 100 Bothwell Street, Glasgow, G2 7JD,   Email:
[SLC request email].  Please remember to quote the reference number
above in any future communications.

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
decision.  The Information Commissioner can be contacted at:

Information Commissioner's Office
Wycliffe House
Water Lane
Wilmslow
Cheshire
SK9 5AF

Yours sincerely
