The information you requested was:-

 

Please provide a list of councillors who voted to charge for the uplift of
Brown bin waste.

 

I consider that the information related to your request as a whole is
subject to an exemption under the Freedom of Information (Scotland) Act
2002 (FOISA). Section 39(2) of FOISA effectively exempts all environmental
information from disclosure requiring instead that it is considered under
the Environmental Information (Scotland) Regulations 2004 (EIRs).  I
consider the substance of your request to be covered by the definition of
environmental information contained in the EIRs, and have accordingly
processed your request under the EIRS.

The motions relating to the budget begin on page 167 and the voting is
recorded from page 198. I have been advised that the minutes don’t
specifically mention the bin charge as no party or independent group chose
to reject the charges in their motion.

 

Details of the motions mentioned on page 167 (Report No. 17/47) can be

Please see page 107 for details of the reinstatement of charging for the
domestic Garden Waste Service.

 

I therefore consider all of this information to be exempt under the terms
of Regulation 6 (1) (b) of the above legislation, which allows an
authority to refuse to provide information in a particular form or format
if the information is already publicly available and easily accessible to
the applicant in another form or format.
