I would be grateful if you would provide me with the following information.

1. The precise date officials at Haringey Borough Council were informed that Councillor Ishmael Osamor had been charged with drug offences and the precise date officials were informed of the outcome of his case. Also, the precise date the Leader and Deputy Leader of Haringey Borough Council were made aware of this prosecution by council officials and when they were made aware of the outcome of this case.

2. Whether or not Councillor Osamor has received any legal or communications advice from council officials regarding this prosecution.

3. Any correspondence that has been sent relating to this prosecution from Councillor Osamor’s official email address, either internally or externally, and the full disclosure of that correspondence.

4. How many official meetings the Chief Executive of Haringey Borough Council, the Leader and Deputy Leader of Haringey Borough Council have had since May 2018 with Councillor Osamor where his case was discussed.

5. Haringey Borough Council’s employment policy regarding the future employment of any council official convicted of possessing drugs with intent to supply.

6. How many occasions since May 2018 the Leader and/or Deputy Leader of Haringey Borough Council have met with Kate Osamor MP on council premises and the dates of those meetings.

7. To publish any internal correspondence sent from the official HBC email addresses of the Leader, Deputy Leader and Chief Whip of HBC relating to the prosecution or conviction of Councillor Osamor.

Thank you for your request for information received on 29 October 2018, in
which you asked for the following information:

1.The precise date officials at Haringey Borough Council were informed
that Councillor Ishmael Osamor had been charged with drug offences and the
precise date officials were informed of the outcome of his case. Also, the
precise date the Leader and Deputy Leader of Haringey Borough Council were
made aware of this prosecution by council officials and when they were
made aware of the outcome of this case.
We have no records containing this information, but we understand that
both Haringey officers and senior elected members were made aware of this
matter when it became a press story on or around 26-10-18.

2. Whether or not Councillor Osamor has received any legal or
communications advice from council officials regarding this prosecution.

The ex-Councillor did not receive any such advice. Council legal officers
would not advise Members on personal legal matters.

3. Any correspondence that has been sent relating to this prosecution from
Councillor Osamor’s official email address, either internally or
externally, and the full disclosure of that correspondence.

This information, if there are any such emails, would not be covered by
the FOI Act. Information held or generated by Councillors is only covered
by the FOI regime where the information is generated for the purposes of
conducting official business on behalf of the Council.

4. How many official meetings the Chief Executive of Haringey Borough
Council, the Leader and Deputy Leader of Haringey Borough Council have had
since May 2018 with Councillor Osamor where his case was discussed.

None.

5. Haringey Borough Council’s employment policy regarding the future
employment of any council official convicted of possessing drugs with
intent to supply.

Councillors are not Council employees. The applicable document would be
our Members' Code of Conduct, a copy can be found in part 5 Section A of
our Constitution .
6. How many occasions since May 2018 the Leader and/or Deputy Leader of
Haringey Borough Council have met with Kate Osamor MP on council premises
and the dates of those meetings.

None.

7. To publish any internal correspondence sent from the official HBC email
addresses of the Leader, Deputy Leader and Chief Whip of HBC relating to
the prosecution or conviction of Councillor Osamor.

Dear Haringey Borough Council,

Thank you for your reply.

I am not satisfied with your response to my first question. “On or around” is not the precise date. I do not understand why the council leader and deputy council leader cannot clarify whether they were informed on October 26 or if it was before this date. It is not conceivable that only two weeks after these events they cannot recall the precise date.

I would be grateful if you would provide this information as the public has a right to know whether or not a senior councillor was aware of a criminal matter before it became public.

"Councillors are not Council employees."

While the council has made a correct statement in response to your question five, it does not answer the question.

If I were you, I would not be satisfied with it. While you may or may not know the distinction between a Council Official and a Councillor, your question was still perfectly valid.

To be clearer, Councillors are the Council and the council employs the Chief Executive who is head of paid staff that includes council officials (i.e. permanent staff).
