I would like to request a complete list of suppliers/contractors and consultants that have been used over the past year when procuring IT Software and the total spend on IT Software during the past financial year.

Also could you break this Software spend down
to show which department uses which application.

Please also provide details of IT Contracts Managers and any
person(s) involved in IT Software procurement.

Request for Information

Thank you for your request for information dated 9 February 2010 (received
by the Council that same day) which has been passed to me for attention.

You have requested the following information and I am dealing with each
point in turn:

I would like to request a complete list of suppliers/contractors and
consultants that have been used over the past year when procuring IT Software
and the total spend on IT Software during the past financial year.

Also could you break this Software spend down to show which department uses
which application.

Please also provide details of IT Contracts Managers and any person(s)
involved in IT Software procurement.

The Council does not hold the information in the form you have requested
as this information is not systematically coded in the Council's Purchase
Ledger in a way which would allow for the accurate identification of these
costs. We have estimated that it will cost well in excess of -L-600 to
provide you with the information you have requested. The Council does not
have to provide you with the information requested in terms of Section
12(1) of the Freedom of Information (Scotland) Act 2002 where it would
cost the Council over -L-600 to do so. For further details on the

In order to put this into context for you, I should explain it would not
be feasible without disproportionate effort and expenditure of time to
attempt to collate the information from across the Council as this would
require a manual search of invoices. With regard to consultants I would
advise that in order to provide you with the information whether somebody
is acting as a consultant in the context of software procurement we would
need to analyse all contracts related to the provision of services by
applying a judgement on whether the type of work carried out is carried
out "when procuring software". For clarification, I should also explain
that the Freedom of Information (Scotland) Act 2002 was introduced to
ensure that people have the right to request access to "recorded
information" held by public authorities such as the Council. In terms of
Section 1 of the Act "recorded information" is information that already
exists in some permanent form e.g. correspondence or databases. However,
under the Act public authorities are not required to create new
information.

As a record of what the Council holds in recorded format in the context of
your request and in order to be more helpful I attach an extract from the
Council's contract register in spreadsheet format which you may want to
search for the information you have requested.

Though I have been unable to supply the information requested, I have
enclosed a copy of the council's contract register, see
TPCContractsRegister.xls attached, which I hope will be of some help to
you.

FREEDOM OF INFORMATION (SCOTLAND) ACT 2002: YOUR RIGHT TO COMPLAIN

Your Right to Complain to the Council

If you are dissatisfied with the way in which Angus Council has dealt with
your request for information under the Freedom of Information (Scotland)
Act 2002 (the Act), you have a right to ask the council to review its
actions and/or decisions regarding your request. If you wish to do this,
you should make your request to the Head of Law and Administration, Angus
Council, Angus House, Orchardbank Business Park, Forfar DD8 1AN or e-mail
[Angus Council request email] within 40 working days.

Your request must:

. be in a recordable format (letter, e-mail, audio tape etc);

. give your name and address for correspondence;

. give details of the information which you originally requested
from the council; and

. give the reasons why you are dissatisfied with the way in which
your application for information has been dealt with.

Your application for review will then be considered by the Council's
review panel. The review panel will write to you informing you of its
decision not later than 20 working days after receipt of your request for
a review. The review panel will also provide you with a statement of its
reasons for arriving at the decision it has made.

Your Right to Complain to the Scottish Information Commissioner:

If you are dissatisfied with a decision of the Council's review panel (or
where the review panel has not provided you with a response), you have the
right to apply to the Scottish Information Commissioner for a decision as
to whether your request for information has been dealt with by the Council
in accordance with the Act.

Your application to the Scottish Information Commissioner must:

. be made within 6 months of receipt of the decision of the
Council's review panel (or within 6 months of the date that the review
panel should have responded);

. be in a recordable format (letter, e-mail, audio tape etc);

. give your name and address for correspondence.

. give details of the request for information which you
originally requested from the council;

. give details of why you were dissatisfied with the Council's
response to your original request;

. give details of why you were dissatisfied with the decision of
the Council's review panel.
