Impact on Claimants
1. How many court summonses for non-payment of council tax were
issued in the financial year 2014/15?
2. How many working age Council Tax Benefit claimants had a court
summons issued against them for non-payment of council tax in the
financial year 2014/15?
3. How many liability orders were issued for non-payment of council
tax in the financial year 2014/15?
4. How many working age Council Tax Benefit claimants had a
liability order issued against them for non-payment of council tax
in the financial year 2014/15?
5. How many court summonses for non-payment of Council tax were
issued in the financial year 2014/15?
6. How many working age Council Tax Support claimants had a court
summons issued against them for non-payment of council tax in the
financial year 2014/15?
7. Of those summonsed in 2014/15 in receipt of working age Council
Tax Support, how many were charged court costs and what was the
total amount of those costs?
8. How many liability orders were issued for non-payment of council
tax in the financial year 2014/15?
9. How many working age Council Tax Support claimants had a
liability order issued against them for non-payment of council tax
in the financial year 2014/15?
10. Of those working age Council Tax Support claimants with a
liability order issued against them in 2014/15, how many:
a. had deduction from benefits requested?
b. had deduction from earnings requested?
c. had bailiffs engaged for enforcement?
d. were already in debt to the council?

Impact on Finances
1. What is the total number of residents who had to pay more
council tax under the authority's Council Tax Support Scheme in
2014/15 than they would have had to pay under the old national
Council Tax Benefit?
2. How many of these residents were in arrears with their council
tax at the end of the 2014/15 financial year?
If responding to any question in this request would exceed the
section 12 cost limit, please respond "information not held" for
that question and fulfill the remainder of this request.

Thank you for your request for information about Council Tax recovery

 

Some of the information you have requested is detailed below, however  we
are unable to differentiate between working age Council Tax Benefit and
Council Tax Support claimants who had either a summons, a liability order
or incurred court costs  from other customers who have had a summons,
liability order or incurred court costs. 

 

In order to provide you with the information on the scale that you have
requested would require the Council to manually check every record which
would exceed the appropriate limit.

 

Section 12 of the Act makes provision for public authorities to refuse
requests for information where the cost of dealing with them would exceed
the appropriate limit, which for local government is set at £450. This
represents the estimated cost of one person spending 18 hours determining
whether the department holds the information, locating, retrieving and
extracting the information.

 

We estimate that it will take us in excess of 18 hours to determine
appropriate material and locate, retrieve and extract the information in
reference to your request. Therefore, your request will not be processed
further.

 

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
original letter and should be addressed to: Mr Shaun Walsh, Transformation
Manager.

Council Tax ex councillor questions Town and District Council

I would like to know if a complaint is actually laid before the Magistrates prior to a summons being issued by the Magistrates for non payment of Council tax?
