Further to your attached claim, in accordance with section 76 of the Magistrates Court Act 1984 ("MCA 1984") If issued by a Magistrates Court, or section 85 of the County Courts Act 1984 ("CCA 1984") if issued by a County Court, I require you to provide evidence for the lawfulness of your claimed enforcement powers.
B. Under your obligations under schedule 12 of the Tribunals Courts Act 2007 ("TCA 2007") you must legally provide me with the following evidence to support any claimed rights:
1. The details of the court issuing the liability order which creates your right and my alleged obligation, and
2. the case number, and
3. the details of the issuing judge, and

Sheffield City Council’s response to your request is set out below:
The Local Government Finance Act 1992, a copy of which is available at
[1]www.opsi.gov.uk requires “each billing authority to levy and collect a
tax, to be called Council Tax, which shall be payable in respect of
dwellings situated in its area”.
Liability for Council Tax therefore arises under the Local Government
Finance Act 1992 and subsequent regulations and, as such it is not reliant
on either your consent or, the existence of a contractual relationship
with Sheffield City Council. The absence of either a contract or consent
does not preclude you from payment of Council Tax.
The Council Tax (Administration and Enforcement) Regulations 1992 (SI
92/623) (as amended), sets out the legal proceedings to be followed by a
Local Authority in the billing and collection of Council Tax.
If you have any queries about this response, please do not hesitate to

Hi David. the councils latest answer to this long running fraud is that Parliament is sovereign ? Only WE the people are sovereign.

Thank you for your email of the 20/02/2023, in which you requested a
review of Sheffield City Council’s response to your Freedom of Information
request. We endeavour to provide a response to internal reviews within 20
working days. However, a review can sometimes be delayed and I apologise
for this.
I can now confirm that a full and impartial review of the decision made in
this case has been conducted with a summary as follows:
You contacted the council on January 19^th 2023 with the following
request:
Can the Council please provide me with documentation proving that people

Can you really prove our obligation to pay?.
The response that you received on the 16/02/2023 provided an answer to the
question outlined above.
Your email received by the Council on 20/02/2023 explained that you were
requesting an internal review of the response you received.
I have reviewed the information disclosed (alongside your complaint) and
have determined that firstly, the Council is in breach of the Code of
Practice under section 45 of the FOI Act, which requires a response to an
internal review within a month; and we have taken three months to reply.
We sincerely apologise for this but we have had a significant backlog of
requests that is taking us a long time to get through.
In relation to the points raised in your request for internal review, I
can confirm that the initial response provided to your FOI request should
be upheld. I have made some further enquiries within the Council and can
advise that following the link below, will provide further context
regarding the obligation to pay Council tax which may be of assistance.

They (sheffield city council) cannot, as any ACT is not law and any ACT requires the Consent of us- the governed to have the force of law. ATB
