Dear Mid Sussex District Council,

Council Tax Liability Orders (prescribed forms omitted since 2003)

Please provide under the FOIA a copy of what the council are using to enforce non-payment of council tax in place of the prescribed court sealed magistrates court liability order.

The Council Tax (Adminstration and Enforcement) (Amendment) (No. 2) (England) Regulations 2003.

The Council complies with The Council Tax (Administration and Enforcement) Regulations 1992.

The regulations do not require the Liability Order to be Court sealed, only signed by the Magistrate, a Justice of the Peace or District Judge.

I am writing to request an internal review of Mid Sussex District Council's handling of my FOI request 'Council Tax Liability Orders (prescribed forms omitted since 2003)'.

Mid Sussex District Council were not asked if they comply with The Council Tax (Administration and Enforcement) Regulations 1992 but to provide a copy of what Mid Sussex District Council are using in place of the prescribed forms omitted since 2003 to enforce non-payment of council tax.

Please accept our apologies. We believe the original request was misinterpreted by our Revenues & Benefits Team. Please find attached a copy of the letter which is sent out in place of the prescribed forms. The Council Tax (Administration and Enforcement) Regulations 1992 (amendment 2003), stipulate that " the order shall be in the form specified as Form A in Schedule 2, or a form to the like effect". Please note the letter has black lines in it, which indicate where personal data has been redacted.

Dear Ms Glister,

Your original request asked for " a copy of what the council are using to enforce non-payment of council tax in place of the prescribed court sealed magistrates court liability order. In your review you asked for "a copy of what Mid Sussex District Council are using in place of the prescribed forms omitted since 2003 to enforce non-payment of council tax", which we have sent you. You are now asking for a copy of the Liability Order granted by the Magistrates Court, which is a different thing altogether. We will log this as a new request and respond accordingly.
