Re: Council Tax Liability Order Enforcement and Bailiffs acting for BANES

This is a freedom of information request within the meaning of the Freedom of information Act. Please provide the following information regarding record keeping:

1. Can you confirm how long (number of years) BANES keep record on a person for non-payment of Council Tax?

2. Can you confirm how long BANES keep record of actions taken by it and/or its instructed bailiffs to collect unpaid Council tax from a liable person?

For the Council Tax period 1st January 2010 to 30th December 2010, please provide the following information regarding BANES instructed private Bailiffs (Bailiffs) and enforcement of Council Tax Liability Order:

3. How many people were summonsed for Council Tax arrears?

4. of those people, how many, in total and as a percentage of (3) above were issued Liability Orders.

5. Of the total Liability Orders issued in (4) above how many in total and as a percentage were passes to Bailiffs?

6. Please confirm whether or not BANES required Bailiffs to file copy of notice/s, including Notice of Seizure of Goods, they left at a property on Council tax arrears enforcement visits.

7. Please confirm whether or not Bailiffs were allowed to force entry into a property, which they have not entered before and without Notice of Seizure, to seize goods for Council Tax arrears.

8. Please confirm whether or not Bailiffs were, in some ways or not at all, allowed to obtained key to a property from Landlord/Agent and used it to enter a tenant home, without his knowledge/consent, to seize goods for Council Tax arrears?

9. Please confirm whether or not BANES kept record of reported cases on (4) above, whether by the bailiffs or residents, and the number of cases reported to BANES.

10. Please confirm whether or not BANES had allowed, supported or assisted Bailiffs to carry out action stated in (8) above. If BANES had, please confirm the regulation or legal authority under which it acted.

11. Please provide copy of BANES Pre 6th April 2014 Policy and Guidance on contracted Bailiffs and enforcement of Liability Order for Council Tax arrears.

In the even that you come to the conclusion that the total request made exceeds your threshold amount under the act, please consider this request to be 11 independent and sequential requests for the information on a single year basis commencing with council tax year period 1st January 2010 to 30th December 2010. In the event you refuse to so consider this request, I will make 11 such sequential and independent requests and refer your earlier refusal to the ICO.
