Response to this request is long overdue. By law, under all circumstances, Preston City Council should have responded by now (details). You can complain by requesting an internal review.

Dear Preston City Council,

After further investigation we have discovered
Council tax is optional.

We suggest you forward the following to your legal team.

United Kingdom Supreme Court on 24/01/2017 in Miller & Anor, R (on the application of) v Secretary of State for Exiting the European Union [2017] UKSC 5 at paragraph 46 main points states:
1. By virtue of the prohibition Parliament has imposed on the making of any provision imposing taxation contained within Schedule 2;1(1)(a) of the European Communities Act 1972 the provisions of the Local Government Finance Act 1992 imposing the Council Tax are invalid and of no effect in the law of the UK.
2.By virtue of the prohibition Parliament has imposed on the Crowns authority or power to confer power to legislate contained within Schedule 2;1(1)(c) of the European Communities Act 1972 the provisions of the Local Government Finance Act 1992 imposing the Council Tax are invalid and of no effect in the law of the UK.
3.As the provisions of the Local Government Finance Act 1992 are not provisions of law, there is no ‘obligation in law’ to pay the Council Tax, and an individual can lawfully withhold payment of the ‘Council Tax’.

Dear FOI Freedom of Information Mailbox,

We have now provided you with evidence that paying council tax is optional and yet you cause people harassment alarm and distress by demanding money you aren't entitled to. You then process fake notices of liability orders but liability orders don't exist. You also illegally deduct monies from peoples benefits.
We requested you pass the evidence to your legal team and suggest you do as requested as this investigation is well above your pay grade.

This is no longer a matter for the ICO as the information we originally requested (liability orders) dont exist.

We shall carry out further investigations and then produce a press release.

There won't be any further FOI requests from us as we've now gathered sufficient evidence to produce a strong case.

As per usual their rebutt didn't really explain much at all. So is the jist of this that when we entered the EU the UK government didn't have any rights of their own to create any new legislation on taxation, or lost that right when we left

It clearly says in the Local Government Finance Act 1992 it's a new taxation and I quote "An Act to provide for certain local authorities to levy and collect a new tax, to be called council tax; to abolish community charges; to make further provision with respect to local government finance (including provision with respect to certain grants by local authorities); and for connected purposes."

They can't deny it, the government at the time has created a new taxation illegally and also increased taxation so are we all entitled to a refund of the difference from when they've increased it?
