Council Tax Expenditure/Collection Procedures 2010/2011

Dear Enfield Council,

Under The Freedom of Information Act I require you to provide the following information.

A - The total amount billed for Council Tax for the year 2010/11

B - The total amount received for the year 2010/11

C - A detailed breakdown of how these funds are allocated and to who. I require exact sums to the nearest penny & NOT rough percentages as quoted on the yearly tax bill.

D - The total number of Liability orders issued to non payers.

E - A detailed breakdown of how you warrant £85 costs per court summons and how this is calculated to the nearest penny & justified when I have it on good authority the actual cost is a fraction of £85.

F - Why you cannot/wont provide a true and original copy of a liability order clearly showing the court seal per individual order granted.

G - A clear and concise explanation of how you legally obtain a private individuals employee information (taking into account the data protection act) to be able to apply an attachment of earnings order to there salary and deduct monies without that individual providing such details of there employer? The law clearly states you are entitled to apply an attachment of earnings order or a fine of upto £1000 to those that dont comply. If you are allowed to obtain information by other means please explain these means and why therefore you bother to send out a AOE request form if you can legally obtain the information without this form.

Dear Geoff Waterton,

Thank You for your response.

You state that you do not have access to employment records of tax payers yet I have it on good authority that you have applied an attachment of earnings order to a tax payer without that person revealing any details of there employer whatsoever.

So I will ask you again. If as you say you do not have access to taxpayers employer records, how have you legally managed to obtain information and supply an attachment of earnings?

Secondly I would like you to clarify clearly, concisely and lawfully how you can issue a liability order on someone. Charge them for it. Hound them for it but do not have to prove that such a order exists. I therefore would ask you to explain fully this time.

The answers and figures provided to my other questions are currently being digested and I will be back to you shortly.

In the meantime I expect an explanation to the issues I have raised today at your earliest convenience otherwise I will be taking the matter further with a view that Enfield Council has broken the Data Protection Act by unlawfully obtaining information and applying an AOE mandate to the salary of a taxpayer without that person supplying any information to you.

Morning,

I would need to look at the taxpayer's record to find out where we got the information from but you would need authority to deal with his/her account before I could reply to you direct. Alternatively I can write direct to the taxpayer if you provide details of the account. The Magistrate signs a copy of the liability order application once it is granted which has the details of the cases attached. There is not an individual signature for each case.

I can inform you though that aforesaid individual has today requested exact details from Enfield Council taking into account your statement that the council does not have access to taxpayers employers details.
