Response to this request is long overdue. By law, under all circumstances, South Cambridgeshire District Council should have responded by now (details). You can complain by requesting an internal review.

Dear South Cambridgeshire District Council,151officer/data controller

We ask the 151 officer as they have a fiduciary obligation and a legal duty of care .

We ask if the coucil tax summons /south cambs documents are,

Written in plain english in line with the posting rule ,

We also ask where on the document's, conspicuos grammer/text is used, and for what purpose.

We also ask under freedom of information what style guide/manual is used to create the council tax document / south cambs documents, for the sake of ambiguity.

Yours faithfully,

I dont think the council will respond , why would they incriminate themselves . Most of The document's that the council produce are void, as they contain debased grammer, i wont go into detail as you should already be aware, hence the council will be unable to reply .. i belive this to be a breach of fiduciary obligation , i.e due dillgence etc etc .IT-IS-VERY-CLEAR to see .. .
If you belive i am wrong the (council) 151 officer will have no problam in providing a lawful reply .

Unfortunately everybody ("police,solicitors,HMRC ,HMCTS ")go a bit quite when posed with the same request of information .

If you suspected a system of being dupilicitous ,fraudulant , etc , would you keep paying money into it?? I belive that is a crime in its self .

Its not hard, try using proper nouns instead of debased grammer , plain english its not to much to ask from a fiduciary (alex colyer 151 officer).

IGNORANCE-OF-THE-LAW-IS-NO-EXCUSE.

Joseph,

(Constructive fraud is a legal fiction describing a situation where a person or entity gained an unfair advantage over another by deceitful or unfair methods. Intent does not need to be shown[1] as in the case of actual fraud. Some unfair methods may include not telling customers about defects in a product.

The elements are:

    a duty owing by the party to be charged to the complaining party due to their relationship;

    violation of that duty by the making of deceptive material misrepresentations of past or existing facts or remaining silent when a duty to speak exists;

    reliance thereon by the complaining party;

    injury to the complaining party as a proximate result thereof; and
    the gaining of an advantage by the party to be charged at the expense of the complaining party.)

Just in case you are unaware.

A recent emai from south cmabs district council and 3C it seems

Dear Mr Walker

ME: please identify who mr walker is ??.

Thank you for your recent email.

I must advise that the Council Tax charge remains due and recovery action will continue, irrespective of any outstanding Subject Access Request. I can see you have an arrangement in place to clear the arrears through weekly payments of £50.00. However, you are currently behind with your payments to the amount of £250.00.

In order to stop further recovery action being taken, you will need to bring the arrangement up to date before the next payment is due on 7 September 2018.

I hope this clarifies the situation.

Best regards

Karen

Plain english !!!

The posting rule (or mailbox rule in the United States, also known as the "postal rule" or "deposited acceptance rule") is an exception to the general rule of contract law in common law countries that acceptance of an offer takes place when communicated. Under the posting rule, that acceptance takes effect when a letter is posted (that is, dropped in a post box or handed to a postal worker).[1] In plain English, the "meeting of the minds" necessary to contract formation occurs at the exact moment word of acceptance is sent via post by the person accepting it, rather than when that acceptance is received by the person who offered the contract.

The rules of contracts by post (postal rules) include the following:

An offer made by post/letter is not effective until received by the offeree.
Acceptance is effective as soon as it is posted.
For revocation to be effective, it must be received by the offeree before they post their letter of acceptance.

One rationale given for the rule is that the offeror nominates the post office as his or her implied agent, and thus receipt of the acceptance by the post office is regarded as receipt by the offeror. The main effect of the posting rule is that the risk of acceptance being delivered late or lost in the post is placed upon the offeror. If the offeror is reluctant to accept this risk, he can always expressly require actual receipt as a condition before being legally bound by his offer.
