Dear Calderdale Metropolitan Borough Council,

Please provide the following information for the years spanning 2010 to date.

1) The amount the Council expected to collect for that year;

2) The actual amount the Council collected in that year, excluding payments subject to court or collection proceedings;

3) The actual amount the Council collected in that year from payments subject to court or collection proceedings;

4) The number of cases in that year which the Council had to issue a First Notice letter to;

5) The number of cases in that year from 4) that were subsequently progressed to court;

6) The number of cases in that year from 4) that were subsequently progressed to collection proceedings;

7) The amounts recovered and outstanding in that year from the cases in 4);

8) The amounts recovered and outstanding in that year from the cases in 5);

9) The amounts recovered and outstanding in that year from the cases in 6);

10) The total cost to the Council of pursuing the cases mentioned in 4);

11) The total cost to the Council of pursuing the cases mentioned in 5);

12) The total cost to the Council of pursuing the cases mentioned in 6);

13) The total cost to the Council for applying for court proceedings in each year, as invoiced from the court;

14) The costs to the council of issuing an individual summons;

15) The cost to the Council of issuing a Bulk Summons, or a summons in which multiple people can be summonsed for one single fee;

16) The amounts recovered and outstanding for each year that represent fees, court costs, bailiff costs, or any other cost added to an account which is not itself considered Council Tax;

17) The number of complaints the Council received in each year about the conduct of any bailiffs, debt collection agency, or other agent or organisation appointed to recover outstanding Council Tax owed;

18) Any correspondence which indicates whether the Council, its agents, or anyone appointed by the Council has ever been blamed, or held responsible, or held culpable, or has indeed being prosecuted, for causing harassment in the pursuit of Council Tax;

19) Any correspondence which indicates whether the Council, its agents, or anyone appointed by the Council, has ever been blamed, or held responsible, or held culpable, or has indeed being prosecuted, for causing the death of a person in the pursuit of Council Tax;

Thank you for your response to our request. We are slightly confused as to your statement that Calderdale Metropolitan Borough Council (CMBC ) does not record certain information, or does not possess that information.

Could you confirm that CMBC definitely does not hold the information requested in points 7 through to 12, and points 14 through to 17? It seems that some of this information must be recorded as it relates to public expenditure and must surely be accounted for?

Thank you for your email detailed below. I have made further enquiries regarding this matter and can respond as follows:

The information requested cannot be provided as it is not held separately

For example

Where we issue a first (reminder) notice we obviously record that a notice has been issued but we have no requirement to analyse how many pay the amount of that notice and how may or may not be still outstanding: It is irrelevant.

The costs involved in recovering from those who do not pay is part of the overall costs of administering Council Tax and is not separately recorded etc

So as suggested where indicated we do not hold the information requested separately.

Dear Calderdale Metropolitan Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Calderdale Metropolitan Borough Council's handling of my FOI request 'Council Tax Collection and Expenditure'.

The reason for the review is that Janet Morris claims that some of the information requested is not held or recorded separately, however, since making the request we have had sight of a performance management document issued by Calderdale Metropolitan Borough Council called "Council Tax Collection - value for money", dated the 7th May 2014, which actually indicates that the Council do indeed record this information and are fully aware of the figures and cases involved.

A Google search of "calderdale council tax recoveries appendix 2" should list this document first in the results pages and we shall add a copy of this document to this request.

We suggest that the responses given by Janet Morris are blatant lies and we request that someone in a senior position reviews this request and attempts to resolve this issue immediately as this request is now overdue.
