We write further to your recent correspondence.

Upon reviewing your request, it is the Council's position that it does not meet the requirements of the Freedom of Information Act in that it is not a valid request for recorded information. Your correspondence stated:

"We will be grateful if you would confirm the following:

2. That you have confirmed that Liability Orders are unlawful"

This is not a legitimate request for recorded information held by Wirral Council.

By way of information however, we can confirm that all Local Authorities including Wirral Council, are legally obliged to levy and collect Council Tax to assist in providing the funding for the services for the communities they represent. This legal standing is supported by legislation, notably the Local Government Finance Act 1992 and other supporting legislation such as the Council Tax Administration and Enforcement Regulations 1992. This has been the case since the Council’s Tax inception in the year 1993. Prior to then, similar legislative powers were conferred upon Local Authorities to raise revenue to provide services though the administration and collection of Community Charge and General Rates.

Your FOI request did not request any paper, electronic or any other media records. Your request sought confirmation of an opinion as to the legality of Council tax and Liability Orders. That is not a valid request for information under the Freedom of Information Act 2000.

Wirral Council is legally obliged to levy and collect Council Tax, as set out within the relevant legislation provided to you in our original response.
