Dear Calderdale Metropolitan Borough Council,

Please provide us with the following information.

1) Details of any methods which the council can use to reduce an individual's Council Tax bill to zero. Please specify any law or legislation which enables the council to do this.

2) Figures on:
a) how many times this method has been used;
b) the individual amounts which have been written off;
c) the total amount which has been written off;

3) Figures on:
a) How much Council Tax was collected between 2008 and 2018, broken down by year;
b) How much Council Tax was outstanding for each year between 2008 and 2018;
c) The total cost involved with pursuing collection of the outstanding amounts in Part b), broken down by each year between 2008 and 2018.

4) Who issues the documents the council refer to as "Liability Orders" which the council posts to individuals in respect of Council Tax?

5) Any information the council holds which shows that the "Liability Orders" issued are not, in fact, lawful or legal.

Dear Tracy Moorby,

Thank you for your response and information.

We are still awaiting on some of the information detailed below.

In our original request we asked for "2) Figures on: a) how many times [the council's discretionary power to reduce a bill to zero] has been used;"

You responded: "In total very few individuals have ever been successful in applying for the discretionary
relief, likewise, with any cases remitted through the Courts."

We asked specifically for how many times the council has used its discretionary powers to reduce Council Tax to zero and you have not provided that figure.

If "very few individuals" have had such a reduction then please provide us with the exact number of those "very few individuals" you refer to, broken down by year.

Also provide us with the figures where the cases have had the balance remitted through the Courts because this information has to be recorded by the Court and therefore CMBC must also hold such information. Again, break down the numbers by year.

We also asked for "b) the individual amounts which have been written off;" (in respect to the council's discretionary powers to reduce a bill to zero).

You responded: "We do not hold figures of individual cases that have been remitted or successfully applied for discretionary relief."

We believe that those figures are held because the cases remitted by the Court have to be documented as a matter of the Court record, therefore CMBC must also have those figures and, indeed, you refer to the total amounts that have been written off in 2c.

We ask that you please provide the information requested because that information must be held by CMBC as it has been referred to, and it is obvious that it is held by CMBC as they are the ones making a decision on whether to grant discretionary relief or not.

It is also obvious that CMBC hold the information on how many cases have been remitted by the Court because that is held by the Court and must also be passed to CMBC because how else would CMBC know not to chase someone for a remitted debt?

Good Afternoon,

I have now heard back from my colleagues regarding the points you have made below.

As you have not specified a period of time you would like these figures for I have taken the last 2 years

In 2016/17 we had 4,047 claimants of Council Tax Reduction who were also claiming Pension Credit.
In 2017/18 we had 3,851 claimants of Council Tax Reduction who were also claiming Pension Credit.

In 2016/17 Court remitted £8013 for 10 debts for 2 people
In 2017/18 Court remitted £1820.03 for 3 debts for 1 person
In all 3 occasions the debts written off were accrued from the period 2008 to 2013

For the same period we had 3 successful applicants for the discretionary relief with the total award being no more than £500.
