This foi enquiry is in relation to the most serious level of falsification of records , for example :
If records were found to have extremely malicious content , such as falsely alleging that a man had an allegation of sex abuse against him by a member of the public , and if it was proven that no allegation had been made by the member of the public :

Does your policy/other guidance you use-
Indicate that it would be in the public interest for you to report the member of staff to the Police?
Indicate that you would have a legal responsibility to report the member of staff to the Police?

Response:

Whilst Lancashire County Council has no specific policy or guidance on the particular subject matter of your request, in the unlikely event of such matters occurring they would be dealt with by service managers in line with our HR policies and Code of Conduct.

Any suspected criminal activity by employees of the County Council would naturally be referred to the Police for investigation.

Furthermore, it should be noted that, under Article 16 of the General Data Protection Regulation ('GDPR') individuals can request that factually incorrect personal data about them is rectified.

In order to avoid people being misled by Lancashire County Councils answer to my foi enquiry I am adding this annotation, and due to the area of law being so serious and the matter this relates to remaining unresolved despite the proof of the council employee's wrongdoing.
My foi enquiry asked about their Policy/guidance only,as in what would be most relevant, but their answer focuses on implying what their actual practice is,and what they said is not their actual practice at all in terms of the foi enquiry,which is based on a real set of records they hold;the matter has been through their complaints process and they refused to acknowledge the proof of their employees malicious criminal misconduct.

They know their employee deliberately made the records falsely portray the man as having had a sex abuse allegation against him, yet they continue to hold the records as if they have a right to + totally refuse to correct the records.

The records are greatly disturbing with their employees insinuations that the supposed allegation is being suppressed and concealed by Lancashire county council on behalf of the supposed alleged abuser.

The employee created the records due to her extreme malice towards the man named in the records , and the council know this , and what this makes their supposed safeguarding of the public look like ,the council have done, as far as I know, nothing at all about the criminal misconduct of thei employee, in total contrast to the foi answer they gave .

The Police were contacted, as the council refused to contact them, and the police verbally refused to deal with the matter , so were asked to provide a written explanation of this and there has been zero response from them , except automated acknowledgement, and it has been several weeks now .

So both Lancashire Police and the council appear to be harbouring the council employee despite the malice and illegality of the records and the proof of the employee's deliberate malicious intentions.

It is a long way from the foi answer the Council provided and people should know that what is in a foi answer may not be the actual practice as it certainly isn't in this case .

I thought this annotation was very necessary as Lancashire County council's foi answer is so misleading and the area of law is so very serious .
