Council investigation into planning misconduct: inadequate response which is in BREACH of the FOI ACT.

Response to this request is long overdue. By law, under all circumstances, Oldham Metropolitan Borough Council should have responded by now (details). You can complain by requesting an internal review.

Dear Oldham Metropolitan Borough Council,
Dear Information Manager,

I refer to your appallingly inadequate FOI response dated 5th November 2019:

FURTHER QUESTIONS & REQUEST FOR CLARIFICATION OF YOUR RESPONSE + BREACH OF FOI ACT:

Your response (dated 5th November 2019) states that: "we can confirm that the complaints were considered / investigated from 02 July 2019 to 23 July 2019 by the Director of Economy"

Q1a. How could MY complaints have been investigated BETWEEN these dates when I did not submit my complaint letter to the council UNTIL 12th August 2019? PLEASE EXPLAIN?

Q2. WHAT " decision was reviewed and deemed robust on 16 August 2019 by Deputy Chief Executive, Director of Legal Services, Head of Legal Services, Planning Solicitor, Head of Constitutional Services, Director of Economy and with external counsel". To what 'decision' does this refer???

Q3. Please forward the documentation & reports confirming WHAT aspects of the 'decision' were REVIEWED, HOW conclusions were reached & WHAT conclusions were reached & by WHOM.

Q4. Please explain your reference to 'external counsel'. To what/whom does this refer??
Q5. Was this 'external counsel' paid for out of the public purse?

Your response is no-where near adequate. Such a response is a breach of the Freedom of Information legislation. The response is vague, unclear & avoids direct answers to the questions I asked. I am appalled that you think such a dismissive response is acceptable; a member of the public has requested information as to the progress, outcome & details of a complaint submitted to the council on 12th August. This response totally avoids providing those answers in breach of the FOI act.

Yours sincerely,

Ms Skelhorn

Yours faithfully,

Ms Skelhorn
