Dear Sharon Druett,

I do not wish to insult the integrity of the FOI customer services at Swindon Borough Council but i do find it rather staggering that you feel you have met the statutory 20 days deadline when the original FOI request was made over a year before you even responded.

To avoid the obvious confusion caused i shall instead make a brand new request for the information i didn't receive, even a year on.

I shall also indeed contact "The Information Commissioner's Office" in due course.

It would however be my advice, for future reference, that when the whole of the information requested hasn't been provided, especially considering the time frame involved, that the person requesting the information is most likely to be unhappy with the information and service you have given them.

Yours sincerely,

Martin Score

Dear Mr. Score,

FW: FOI101000340068Freedom of Information request - Council Funding
Commitment Swindon

I have attached the response that was originally sent to you on 27^th June
2012 and the email that was sent to you on 29^th May, 2013.

This is why the Council considers it did reach the statutory deadline in
response to your original request.

I note you have said:

It would however be my advice, for future reference, that when the whole
of the information requested hasn't been provided, especially considering
the time frame involved, that the person requesting the information is
most likely to be unhappy with the information  and service you have given
them.

As per my previous response you did include the words in your request:

‘ if possible, from the years 2001-2006.’

The Council has also since confirmed that we did not hold the information
that you had requested for years 2001- 2006.

As previously advised, if this does not resolve the matter to your
satisfaction, you have the option of referring it to the Council’s
Monitoring Officer, Stephen Taylor, Director of Law and Democratic
Services to review.

If you are not content with the outcome of this conclusion, you may apply
directly to the Information Commissioner's Office for a decision, before
we have completed our investigation. Generally, the ICO cannot make a
decision unless you have exhausted the Council's own complaints procedure.
