Dear Lisa

Thank you for your recent FOI request dated 24 August 2018 in which you
asked for the following information:-

a list of the latest monthly (if available ) or  Quarterly Payment to
suppliers which include Supplier name, Net Amount,
Department/Directorate/Service Division, Service Description/Expense
category, Transaction date of  Shetland Islands Council

I advise that the Council is able to respond to your request in part, in
that the information in relation to a list of the latest Quarterly Payment
(Quarter 1) to suppliers which includes Supplier name, net amount, Service
description/expense category and transaction date relating to spends over
£500  is recorded information held by the Council.  This information is
contained within the attached spreadsheet ‘FOI 8984’.

The breakdown of payment by Department/Directorate/Service Division is not
recorded information held by the Council.   To respond to your request
would require a review of every payment in order to undertake an analysis
of the information held to then create a response that meets the terms of
your request.  This would be creating new information and therefore in
terms of Section 17 of the Freedom of Information (Scotland) Act 2002
[FOISA], the Council is advising that this information is not held.

With regard to the information provided, our Finance Section have advised
the following:

1.        Supplier Name "Sundry By BACS" and "Sundry by CHQ" and
Electronic Bank Payments - Direct Debit" are for companies that we are
only likely to pay once so do not retain them as a permanent record.

2.        Supplier Name "SIC Purchasing Cards" are purchases made by a
Corporate Credit Card.

I must also advise that in terms of Sections 34 [Investigations and
proceedings] and 36 [Confidentiality] of the Freedom of Information
(Scotland) Act 2002, the Council has withheld detailed information in
relation to certain payments. Such payments were made in settlement of
legal disputes, either in cases where proceedings have concluded and are
subject to a non-disclosure agreement or where matters are still
undergoing a legal process. To release such information into the public
domain at this stage may cause the Council to breach agreed confidences
and would be prejudicial to the Council’s position in any such legal
proceedings now, or in the future.

In addition, under Section 38 of the Freedom of Information (Scotland) Act
2002, the Council has withheld the names of individual clients in receipt
of certain payments, as the disclosure of third party personal information
may cause the Council to breach its duties under the Data Protection Act
1998. These are mainly in respect of clients in receipt of direct payments
for personal care or adoption and fostering allowances.

I trust this response meets your request. However, if you are dissatisfied
with the way in which the Council has dealt with your request for
information then you may ask the authority to review its actions and
decisions in relation to your request by submitting a formal appeal. The
process for lodging appeals is set out in the attached leaflet.
