Dear Kirklees Borough Council,

I'd like to make a request under the Freedom of Information act for all transactions over £500 from April 2018 to December 2018. As a minimum, please make sure to include the date, value and recipient of each transaction.

If it would help, I am specifically looking for payments to suppliers who provide a service in Health and Social Care. This would include all suppliers falling under the categories :-

1. Payments to suppliers who provide fostering and adoption services to the Council
2. Payments to suppliers who provide care services to the council. This would include suppliers who provide care under each of below -
a. Children's Residential/ Nursing Care Providers
b. Adult Residential/ Nursing Care Providers
c. Elderly Residential/ Nursing Care Providers
d. Domiciliary Care Home Providers
e. Supported Living Care Home Providers
f. Care at Home Providers
g. Providers who carry out Homeless Services
3. Payments to suppliers who provide Special Education Services

I am writing in response to your request dated 19 November 2019.  This has
been dealt with under the Freedom of Information Act 2000.

 

You asked for the following information:

 

1.       Payments to suppliers who provide fostering and adoption services
to the Council

2.       Payments to suppliers who provide care services to the council.
This would include suppliers who provide care under each of below -

a.       Children's Residential/ Nursing Care Providers

b.      Adult Residential/ Nursing Care Providers

c.       Elderly Residential/ Nursing Care Providers

d.      Domiciliary Care Home Providers

e.      Supported Living Care Home Providers

f.        Care at Home Providers

g.       Providers who carry out Homeless Services

3.       Payments to suppliers who provide Special Education Services

 

The Council’s response to your specific questions is set out below:

 

The Council does hold the requested information but considers this is
exempt under Section 21 of the Freedom of Information Act, because the
information is reasonably accessible to you by other means, because it is
already in the public domain.

 

Section 21 of the Act provides that:

 

(1) Information which is reasonably accessible to the applicant otherwise
than under section 1 is exempt information.

(2) For the purposes of subsection (1)—

(a) information may be reasonably accessible to the applicant even though
it is accessible only on payment, and

(b) information is to be taken to be reasonably accessible to the
applicant if it is information which the public authority or any other
person is obliged by or under any enactment to communicate (otherwise than
by making the information available for inspection) to members of the
public on request, whether free of charge or on payment.

(3) For the purposes of subsection (1), information which is held by a
public authority and does not fall within subsection (2)(b) is not to be
regarded as reasonably accessible to the applicant merely because the
information is available from the public authority itself on request,
unless the information is made available in accordance with the
authority’s publication scheme and any payment required is specified in,
or determined in accordance with, the scheme.

Is there any particular reason for this drastic decrease or would there be data missing from the reports? We kindly request you to please check with the concerned department(s) to provide us with any missing data if any.

With respect to Q3 - With Special Education Services , we are referring to expenses incurred by the Council for disabled children to attend mainstream education. i.e., SENS expenses paid to those Suppliers who provide a service for issues such as learning disabilities or mental health. This could include transportation to/from school & vendors who create the facilities/supply material to provide that environment.

And as for your follow-up question: " Also, are you looking for figures just for Looked After Children or every SEN child?" -- The answer is "Both"

I received the response from the Service yesterday.  I apologise for any
delay in sending this to you.

 

In response to point 1, about ‘missing data’, please find the attached
dataset showing fostering and adoption services spend.

 

In relation to Point 2, this data is already published and contained
within the expenditure data sets on the Council’s website.  Here is where
the Council publishes information about [1]expenditure over £500

 

In relation to Point 3, “Payments to suppliers who provide Special
Education Services”, the Council provides the Element 3 top up as part of
high needs funding within the school budget allocations.  As a budget
allocation, the Services does not feel this would be viewed as an SEN
service payment or expense to support disabled children to attend
mainstream school.  They would expect that any required service, facility
or material would be commissioned by the school themselves. 
Transportation is provided for a small number of pupils to attend
mainstream school – this is generally pupils who attend specialist
provisions within mainstream school.  I am liaising with colleagues in our
school transport team to determine whether they hold anything additional
to what is already in the expenditure data and will respond to you
shortly.

spreadsheet provided has data from Oct 2018, whilst our request was for
data from April 2018 to Dec 2018. Request you to kindly provide data for
the 6 missing months of April 2018 to September 2018.”

 

We have been in touch with the relevant service, who have provided the
attached spreadsheet together with the following explanation:

 

“The perceived missing data in relation to fostering and adoption spend is
due to a system change in October 2018. Prior to this, the data was
published and can be identified as transactions under Document Type YZ.
The attached spreadsheet is an amalgamation of the published spend data
from April 2018 until November 2018, providing a summary of the spend
volumes and amounts month-to-month and demonstrates how this drops off
following the system change in October 2018. This is why the separate
extract provided only covers October onwards, as the data covering April
until September is already published online.”
