Council Expenditure or Payment to Suppliers from May 2018 - Current

The request was successful.

Dear Sandwell Metropolitan Borough Council,

I'd like to make a request under the Freedom of Information act for all transactions over £500 from May 2018 to Current. As a minimum, please make sure to include the date, value and recipient of each transaction.

If it would help, I am specifically looking for payments to suppliers who provide a service in Health and Social Care. This would include all suppliers falling under the categories :-

1. Payments to suppliers who provide fostering and adoption services to the Council
2. Payments to suppliers who provide care services to the council. This would include suppliers who provide care under each of below -
a. Children's Residential/ Nursing Care Providers
b. Adult Residential/ Nursing Care Providers
c. Elderly Residential/ Nursing Care Providers
d. Domiciliary Care Home Providers
e. Supported Living Care Home Providers
f. Care at Home Providers
g. Providers who carry out Homeless Services
3. Payments to suppliers who provide Special Education Services

In particular I am looking for itemized transactions for suppliers - preferably in CSV format. I look forward to the information at the earliest.

With Special Education Services , we are referring to expenses incurred by the Council for disabled children to attend mainstream education. i.e., SENS expenses paid to those Suppliers who provide a service for issues such as learning disabilities or mental health. This could include transportation to/from school & vendors who create the facilities/supply material to provide that environment.

Thank you for your response, with request for clarification.

With regards to 2g) suppliers of homelessness services, we are referring to :-

Services such as finding temporary/affordable social housing or short-life leasing schemes for the homeless, providing informal move on support. Providing free legal advice and court attendance to help people who’ve lost their homes or are facing eviction. Specialist support like for substance abuse.

Additionally, the payment transactions involved would generally fall under 3 types :-

1. Accommodation Expenses - these would include for eg payments to Bed and Breakfast type accommodations - hostels, etc to give homeless people a roof over their head, a meal and other basic amenities
2. Support Services type transactions - these could include help to enable homeless people to turn their lives around and other support services like transport, assistance with interviews, etc &
3. S17 type transactions - which we understand might be redacted - it gives us an idea of the problem - the support systems required. It gives us an understanding so when we apply economic and other matrices we can understand the outcomes in the future

I am writing to request an internal review of Sandwell Metropolitan Borough Council's handling of my FOI request 'Council Expenditure or Payment to Suppliers from May 2018 - Current'.

This is with reference to "Appendix 1 Sandwell Children’s Trust Response_FS153956706" of your response; which covers 1. Payments to suppliers who provide fostering and adoption services to the Council/Trust & 2. Payments to suppliers who provide Children's Residential/Nursing

We specifically disagree with the exemption applied "Some of the information requested may potentially have a negative commercial impact on legal entities and have therefore been exempted under provisions of the Freedom of Information Act 2000, Part II, Section 43".

This is because the Council is required by law to publish this information. This does not constitute "commercially sensitive" or "personal sensitive" information of any form or type.

· All Councils in England, Scotland & Wales and Northern Ireland now provide this information (We can supply examples on request). We feel Sandwell should comply as have every council done. (Those that have redacted have un-redacted the transactions upon request, where they do not involve the names of private individuals)

· This information should be made available to the public as public funds are involved. The public have a right to know where and to whom the spend arises. Not providing this information is detrimental to the cause and against the rules of the FOI Act

· Whether the information requested may potentially have a negative commercial impact on legal entities (including IFAs) should not be a matter of concern. Other customers data are shown unredacted and the same should apply to Social Care Providers. Whilst we understand some information (Payments directly to a Carer or a child need to be redacted for safeguarding reasons – payments to an IFA or a Care Provider do not raise such issues).

· Negotiations with IFAs to provide services to the Council/Trust are undertaken through a formal tendering process (which should be held in private). These negotiations do not depend on the transaction information (supplied on the basis of FOIA). Hence no trade secrets have been compromised.

We feel by withholding and not providing this information, the Council/Trust are not fulfilling their statutory obligations under the FOIA.

If it would help, we are an organization building systems for Artificial Intelligence through Data Analytics. Our intention in the long term is to work with Local Authorities to optimize the functioning and predict the evolution of Health & Social Care in the UK by creating visions of the future market based on this data.
