Dear Mr Smith,

Thank you for your information request of 1 December 2017.  Aberdeen City
Council (ACC) has completed the necessary search for the information
requested.

Please provide a dataset of council election results from the most recent
council election in CSV format.

All data relating to the most recent local government elections are at the
link below.  They are not held on CSV format.

election results from the most recent council election in CSV format as it
is not held by ACC.  In order to comply with its obligations under the
terms of Section 17 of the FOISA, ACC hereby gives notice that this
information is not held by it.

We hope this helps with your request.

Yours sincerely,

Dear Foi Enquiries,

If the council does not hold the results of its own elections, who does?

Yours sincerely,

George Smith
ODI Aberdeen

Dear Foi Enquiries,

Sorry - please ignore my most recent response. I mis-read what was said.

What we are requesting in all of these FOI requests are sets of open data that any other city would be providing.

In this case it is council election data.

So while you have provided a link to a web page, there are no clear terms to say whether the data is licensed under OGL for re-use. Nor is it in a neutral format, nor machine readable - all of which are pre-requisites of OD.

We assume that the web page is not the council's primary means of storing its election data - and that it will be held in an elections management system.

Normally it would be possible to export that in a fashion for re-use - as CSV or similar.

Can the council

a) check whether the elections system can export the data and make it available as CSV or similar neutral format, and do so?
b) if not, allow us to scrape the data for re-use from the webpage and
c) in either case, give ODI Aberdeen explicit OGL licence to reuse that data

Yours sincerely,

George Smith

Dear Mr Smith,

Thank you for your follow-up email which we received on 19 January 2018.

So while you have provided a link to a web page, there are no clear terms
to say whether the data is licensed under OGL for re-use. Nor is it in a
neutral format, nor machine readable - all of which are pre-requisites of
OD.

We assume that the web page is not the council's primary means of storing
its election data - and that it will be held in an elections management
system.

Normally it would be possible to export that in a fashion for re-use - as
CSV or similar.

Can the council

a) check whether the elections system can export the data and make it
available as CSV or similar neutral format, and do so?

I have been advised that the elections system used can only export in PDF
format as published on our website. ACC does not have access to the
primary data and reports are only available as PDF.

b) if not, allow us to scrape the data for re-use from the webpage and

Our conditions of use for the website
([1]https://www.aberdeencity.gov.uk/terms-an...) excludes the
re-use of data from scraping.

c) in either case, give ODI Aberdeen explicit OGL licence to reuse that
data

Unfortunately, we are unable to confirm that you can re-use this data
under OGL (Open Government Licence). ACC currently does not utilise the
OGL for information made available (including information published on our
website).

We apologise that we are not able to help further.

Yours sincerely,

Grant Webster
