Dear Westminster City Council,

Please can you provide the following information under the Freedom of Information Act:

1 - How many assessments under the Deprivation of Liberty Safeguards were conducted during the period 01/05/2009 to 01/05/2017 by the following:

a.) Council employed Best Interest Assessors.
b.) Independent Best Interest Assessors (not employed directly by the Local Authority).
c.) Mental Health Assessors.
d.) Assessments allocated to 3rd part recruitment agency contracts.

2- Total budget spend on the Deprivation of Liberty Safeguards from 01/05/2009 to 01/05/2017, broken down to include:

a.) The total council spend on DoLS assessments split between employed Best Interest Assessors, Independent Best Interest Assessors, Mental Health Assessors and/or recruitment agencies for the period 01/05/2009 to 01/05/2017
b.) Price paid per BIA assessment.
c.) Price paid per Mental Health Assessment for DoLS.
d.) Total DoLS team budget for 2017-2018.

From our preliminary assessment, we estimate that compliance with your
request would exceed the appropriate costs limit under section 12 of the
Freedom of information Act 2000. This is currently £450.00. We estimate
that the cost will be £5450.00 to comply with your request. We have
decided to refuse the request because in order to meet your request, we
estimate that we would need to retrieve and read 2,620 files at an
estimated cost of £5,450 based on 5 minutes per file.
 
Under section 17 of the Act this response constitutes a refusal notice in
respect of the requested information.

We can provide a more limited response, which I hope might be of use to

With regards to a breakdown of assessments conducted under the Deprivation
of Liberty Safeguards, we can supply the information below for 2015/16
only:
 

1 a.) Council employed Best Interest Assessors. NHS & LA

We have a rota of 28 Best Interest Assessors that is drawn from on to
carry out assessments on behalf of 3 boroughs: the London Borough of
Hammersmith and Fulham (LBHF) the Royal Borough of Kensington and Chelsea
(RBKC) and Westminster City Council (WCC).

1 b.) Independent Best Interest Assessors (not employed directly by the
Local Authority).

We regularly use a pool of 14 independent Best Interest Assessors we use
regularly for 3 boroughs to carry out assessments on behalf of 3 boroughs
(LBHF, RBKC and WCC).

1 c.) Mental Health Assessors.

We regularly use 12 Mental Health Assessors who work in various parts of
the country to carry out assessments on behalf of 3 boroughs (LBHF, RBKC
and WCC).

1 d.) Assessments allocated to 3rd part recruitment agency contracts.

We do not use 3^rd party recruitment agencies.

 

2b.) Price paid per BIA assessment.

The rates we pay to independent BIAs is £300.00 per assessment

2c.) Price paid per Mental Health Assessment for DoLS.

The rates we pay to MHA is £189.00 per assessment

2d.) Total DoLS team budget for 2017-2018.

The budget for the DoLS team which serves the 3 local authorities of LBHF,
RBKC and WCC has a combines budget of £425,000

2e.) Details of the current DoLS team members by name / job title and
number of qualified Best Interest Assessors working in your local
authority. Please include contact details for the current MCA/DoLS Service
lead and DoLS team manager.

We are not prepared to disclose names or details of all of the team
members.

The information is exempt from disclosure under Section 40(2) of the
Freedom of Information Act (FoIA). The information is personal data as
defined by the Data Protection Act 1998 (DPA). As it is information about
someone else the release of this information would constitute a breach of
Principle 1 of the DPA. This is because disclosure would be unfair to
those people who could be identified from the information who have no
expectation that their personal data would be made public.

This response therefore acts as a refusal notice under section 17 of the
FoIA.
