COUNCIL Contact Re HS2

PA &KAE HARLOW made this Freedom of Information request to Cheshire East Council

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

We're waiting for PA &KAE HARLOW to read recent responses and update the status.

Dear Cheshire East Council,

There is considerable public debate about the matter of your council's representations to HS2 and the dogleg the proposed HS2 route takes.
Indeed it has been recorded in the media that your own divergent ( or that of a senior politician who refutes such statements) accounts are fallacious and misrepresentative of the discussions that have taken place.
This is obviously a serious matter of trust and public interest.
I quote from the account of your leader Michael Jones.

" Throughout the process we raised concerns about the line of route and raised the profile for a common sense solution, which I believe we have achieved"

Please provide copies of:
1) the full correspondence in this regard between the Council and HS2 Ltd and any concerns that were raised, proposals put forward regarding the route by the council and how these constituted common sense solutions.
2) Please provide copies of any direct or copied correspondence between the Council and the Cabinet or Parliament in respect of this matter

Yours faithfully,
Paul Harlow

I would delete "proposals put forward
regarding the route by the council and how these constituted common
sense solutions." from Q1 - the Council cannot determine "how these constituted common sense solutions" and the first half of the question will answer the rest.

Dear Mr Harlow

Request for Information - FOI LOG 805983

Thank you for your request for information; in preparing this response I have sought the assistance of staff within various Council departments as contact with HS2 has not been limited to one department. Unfortunately, the amount of information you have requested is very substantial and covers a broad area of information, gathering it together would be likely to involve a significant cost and diversion of resources from the Department’s other work.

It certainly seems likely to exceed the £450 cost limit which the Government has set for dealing with Freedom of Information requests at local government level. The best way we can help you is therefore to ask you to try and narrow down your request to focus more clearly on the precise information you are seeking.

However, I can confirm that prior to the HS2 route being published on 28th January, all communications with central government were made by the Local Enterprise Partnership and not Cheshire East Council. Please see the links to the HS2 website and LEP Website for further information on this - http://www.hs2.org.uk and . http://www.candwlep.co.uk/current-activi....

If you are unable or unwilling to narrow down your request we will, of course, consider it in accordance with our obligations under the Freedom of Information Act 2000, but if it does exceed the cost limit, we may have to charge for the information or even refuse the request.

If you are unhappy with the service you have received in relation to your request and wish to make a complaint or request a review, under the Freedom of Information Act you should write to the Compliance Unit, Cheshire East Council, Westfields, Middlewich Road, Sandbach, Cheshire, CW11 1HZ.

If you are not content with the outcome of your complaint, you may apply directly to the Information Commissioner for a decision. Generally, the ICO cannot make a decision unless you have exhausted the complaints procedure provided by the Council. The Information Commissioner can be contacted at: The Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.

Yours sincerely

Dear FOI East,

Dear Cheshire East Council,
I have revised my request as you indicated you would have problems with it or not comply on grounds of costs.
Please indicate how these costs for FOI disclosure were arrived at, what the cost estimate was and the page volume of correspondence you estimated in order respond as you did.

Revised Request

There is considerable public debate about the matter of your
council's representations to HS2 and the dogleg the proposed HS2route takes.

between the Council and the Cabinet or Parliament in respect of
these HS2 matters that addressed the issue and as disclosed by the leader Michael Jones between 06.08.2010 and Febraury 7th 2013

Dear FOI East,

Dear Ms Raine
this is not a new request.
FOI LOG 805983 8th march your response
I have modified my request in order to reduce its cost as was requested in your letter 8th March in order that you can comply. The information is known and transmittable.
It should not take the time of a new application.
I would be grateful if the information I requested appropo my first letter can be conveyed. It is not a transparent response without that information.

Yours sincerely,

PA &KAE HARLOW

FOI East, Cheshire East Council

Dear Mr Harlow

Thank you for your email to Mrs Raine, to which I am responding.

Under the requirements of the FOI legislation (FOI Act 2000) if we have to write out for clarification or with a request to revise an enquiry, the 20 day response time starts again from when we receive that clarification back - which was yesterday, so the response due date is now 18 April. In this instance we have recorded your clarification under a new reference number merely for administration purposes and to assist the department that will be dealing with the request.

However, as the department are already aware of your request, we may be able to come back to you one way or the other sooner.

I hope this explains the situation satisfactorily for you.
