Council confirms move to EHCP plans in April 2014

Dear North Yorkshire County Council,

According to a North Yorkshire Council document called "Update on Children and Young People's Issues", dated 9 May 2014, presented to the Health and Wellbeing Board, and signed off by Peter Dwyer, Corporate Director of Children's Services and and Janet Probert, Director - Partnership Commissioning Unit , the Council will:

"From the start of the summer term all new requests will follow the new [EHCP] process and this will require further training of Health practitioners.
(Item 6.7)

Please publish the information you provide to parents of children
with SEN who are considering, have requested, or are in the process
of being assessed for, Education Health and Care Plans since you have moved to this new system.

I can reassure you that North Yorkshire is not about to do anything
illegal. The document you refer to is an update on the SEND Strategy. The
quoted sentence might more comprehensively have said, " . . . with the
informed consent of parents" which has always been the Local Authority's 
position. The attached document is for parents and is or will shortly be
on the website of the Parent and Carer Forum (NYPACT) and on the Council's
Local Offer website. It explains in detail what North Yorkshire is
intending to do within the current legislation whilst preparing for
imminent changes in the law.

Thank you for your response.

I note that by adding the phrase as you describe the meaning of the sentence completely changes, otherwise there would be no need to use the word "all" in the original sentence. "All" is absolute and gives no choice, "informed consent" gives choice.

I would be grateful if you could send me the information you currently send to parents when they request an assessment and to schools when they do the same.
