Could you please provide details on the following:

1) An up-to-date list of all assets currently owned by the Council (or please provide a link if publicly available).

1) A list of all assets disposed by the Council since 2000 (or as early to this date as records you hold allow), including the date and reason of disposal (or please provide a link if publicly available). Also, please include details of who the asset was disposed to, such as a partner for future use or as a result of a Community Asset Transfer request, etc.

Thank you for your information request.

Please note that the Council is currently responding to the Coronavirus
(COVID-19) outbreak which may impact on the resources we have available to
respond to information requests.

If you are making a request for information under FOI(S)A we will aim to
respond within the statutory timeframe of 20 working days.

If you are making a request for environmental information under EIRs we
will aim to respond within the statutory timeframe of 20 working days.
However, for requests of a complex nature it could take us up to 40
working days. If so we will write and tell you this.

If you are making a request for information under DPA/GDPR we will aim to
respond within the statutory timeframe of one month except in the case of
complex or numerous requests in which case this period may be extended by
up to a further two months. If so we will write and tell you this.

Notice of Partial Refusal

 

We refer to your request dated 22/02/2022 20:00, for the following
information Foi List of assets currently owned by Aberdeenshire Council. 

 

We confirm that the Council holds the information that you have requested.

1) An up-to-date list of all assets currently owned by the Council (or
please provide a link if publicly available).

2) A list of all assets disposed by the Council since 2000 (or as early to
this date as records you hold allow), including the date and reason of
disposal (or please provide a link if publicly available). Also, please
include details of who the asset was disposed to, such as a partner for
future use or as a result of a Community Asset Transfer request, etc.

We have considered your request, but are of the opinion that the exemption
under the following section of the Act applies to the information
requested:-

Section 25 - Information otherwise accessible

 

Information which the applicant can reasonably obtain other than by
requesting it under the Act is exempt information.

 

In regards to question 1, Please find link to Aberdeenshire’s Asset List

Regarding question 2, Please find attached list of disposals from April
2013, with this information being readily available with this outlining
asset type, disposal date along with reason for disposal.  Information
regarding the buyer is available from the Registers of Scotland through
their Land Information Service website -  [2]ScotLIS - Scotland's Land
Information Service. 

 

 

We are of the opinion that this exemption applies because the information
requested is information which Aberdeenshire Council [or other public
authority], is obliged by [state name of enactment] to communicate to
members of the public on request, whether free of charge or on payment.

 

This exemption is an absolute exemption and therefore we are not obliged
under the terms of the Act to provide you with the information requested.

 

If you are dissatisfied with the way in which we have dealt with your
request, you may require Aberdeenshire Council to review this decision. 
Details of the procedure are attached.
