Ms Tabner,

Thank you for your response to my FOI.

I can check that you have covered the correct time period?

My request was for data between 2014/15 and the date on which the council received my FOI request.

As such that means 01/04/2014 to 31/07/2018.

I fear you may have only given me information relating to 2014/15.

If so, can this be revisited and the additional information supplied?

Yours sincerely,

Gareth Davies

Dear Woking Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Woking Borough Council's handling of my FOI request 'Council assets'.

The response I received to my FOI in August was incorrect, as it provided data on 2014/15 only and not the period I clearly stipulated in the request (2014/15 to July 31, 2018).

I immediately sent this email on August 27:

----

I can check that you have covered the correct time period?

However, two months later I have yet to receive a reply. In effect the message should have been treated as a request for internal review, but it appears that it was not.

This is a clear breach of the FOIA and needs to be looked at as a matter of urgency.

Dear FOI,

I have been supplied with an answer to the wrong FOI request.

I specifically raised concerns about the error in the response to the request, dated July 31, 2018, described below. The complaint was that the response covered 2014/15 only when it should have been 2014/15 to July 31, 2018.

Can this be looked into and the correct response supplied?

Yours sincerely,

Gareth Davies

To the information officer,

I am emailing to request the following information from the council under the Freedom of Information Act 2000:

Note: This request does not relate to social housing stock

1) A list of building, land and heritage assets disposed of (i.e. the council no longer owned the asset) by the council between 2014/2015 and the date on which you received this request, including:

- Name of the asset
- What type of asset is it - building, land or heritage?
- Address (if applicable)
- Postcode (if applicable)
- UPRN (if possible)
- The date it was disposed of
- The type of disposal (for example sale, community asset transfer, etc)
- The valuation of the asset at the point it was classified as an asset held for sale (both lower amount and fair value less, if possible)
- How much it was sold for? (if applicable)
- Who it was sold to?
- How it was disposed of (open market, auction, etc)

2) A list of building, land and heritage assets acquired by the council between 2014/2015 and the date on which you received this request, including:

- Name of the asset
- What type of asset is it - building, land or heritage?
- Address
- Postcode
- UPRN (if possible)
- The date it was acquired
- Who was it acquired from?
- How much did it cost?
- Is it now classed as an investment property?

3) How many land, building and heritage assets did the council have as of
a) the beginning of 2014/15
b) the date on which you received this request

I would like to receive this information electronically a spreadsheet, with the points above as the column headers.

If the decision is made to withhold some of this information using exemptions in the Act, please inform me of that fact and cite the exemptions used.

Please note the questions:
Who it was sold to?
Who was it acquired from?

In response to test FOIs some local authorities declined to release this information relating to these questions, arguing it was exempt under Section 40 - Personal information.

The definition of personal data referred to in the FOIA is that used by the Data Protection Act. This states that, for data to constitute personal data, “it must relate to a living individual, and that individual must be identifiable”. As a result, unless the response relates to a person (or a sole trader) it cannot be exempt under Section 40.

If you need clarification please contact me at this email address. Under your section 16 duty to provide advice and assistance I would expect you to contact me if you find this request unmanageable in any way before the 20th working day.

I would be grateful if you could confirm in writing that you have received this request, and I look forward to hearing from you in the near future.

Thank you for your time,

Gareth

I am writing to request an internal review of Woking Borough Council's handling of my FOI request 'Council assets'.

The response I received to my FOI in August was incorrect, as it provided data on 2014/15 only and not the period I clearly stipulated in the request (2014/15 to July 31, 2018).

I fear you may have only given me information relating to 2014/15.

If so, can this be revisited and the additional information supplied?

----

Two months later I had not received a response.

Then on November 1 I received a message replying to a different FOI. I then sent another email again asking for an internal review into the correct FOI request, and I have still yet to receive the information I have asked for.

Please could you update me as a matter of urgency or I will raise this matter with the ICO.

Gareth Davies

Dear Gareth Davies,

Thank you for your email.

I have attached all the correspondence I have found and this includes an FOI request that was received on 27 July (and stated below) and was responded to on 16 August by Julie Rowling. Following your email on the 31 October explaining you did not receive data for the years you requested, I responded on the 1 November with the missing data. This correlates to the FOI that states:

"I am emailing to request information from the council under the Freedom of Information Act 2000.

For each of the following financial years: 2014/15, 2015/16, 2016/17, 2017/18, 2018/19 (up to the date on which you received this request) I request the following information:

A) The total amount of capital receipts (in £) received by the council following the disposal of any type of asset

B) A breakdown of the use of capital receipts within each financial year by the following three categories:
i)To help meet the cost of borrowing related to capital expenditure
ii)To invest in new capital expenditure
iii) To finance the revenue costs of service reform (as introduced in March 2016 - https://assets.publishing.service.gov.uk...)
iv) Other

C) A list of service reforms financed through capital receipts since flexible use of capital receipts was introduced in March 2016, including:
i) The date the reform began
ii) The amount (in £) of capital receipts used
iii) The savings target at the time
iv) The % of that savings target which has been met to-date

D) The amount of capital receipts (in £) used to meet the cost of redundancies made (or in the process of being made) by the council during each financial year

E) The number of redundancies made by the local authority in each financial year broken down by the service they relate to

I would like to receive this information electronically a spreadsheet, with the points above as the column headers if possible

If the decision is made to withhold some of this information using exemptions in the Act, please inform me of that fact and cite the exemptions used.

If you need clarification please contact me. Under your section 16 duty to provide advice and assistance I would expect you to contact me if you find this request unmanageable in any way before the 20th working day.
