Cost to refurbish Market Hall in Whitehaven

I have received a number of messages following my annotation of Mr Paulley's FOI on this matter and being curious and concerned I would be obliged if you could provide me with information on the refurbishment of the Market Hall in Whitehaven:

1. What was the total budget for the refurbishment of the Market Hall alone before work commenced and what was the total of the successful bid from Ashcroft Ltd for the refurbishment work?
2. Please provide details of any consultants involved in managing the project on behalf of the council and the names of the companies they were paid through.
3. How were the consultants chosen and what were their qualifications and experience in project management and property refurbishment?
4. Who was the person responsible for agreeing their daily rates and signing off their invoices?
5. What was the daily rate paid to the consultants and how much were they paid in total between starting work with the council and finishing?
6. Between what dates was each consultant employed and what other accommodation projects were they involved in?
7. At the time of their appointment, did any of the consultants have any kind of connection or relationship with any senior officers employed by the council directly or on an interim basis? If they did, was a potential conflict of interest declared to the council's monitoring officer? If it was, when was the declaration recorded? Please provide a copy of any declarations of this kind.

Any consultants appointed to assist were procured via normal Copeland
Borough Council practices and procedures.

signing off their invoices?

 

Copeland Directors.

 

 

 5. What was the daily rate paid to the consultants and how much were they
paid in total between starting work with the council and finishing?

 

No specific rate for ‘Market Hall work’. Details of all expenditure is

In order to provide a complete and comprehensive answer to this question
could you please provide me with a working definition of your term
‘consultant’.

kind of connection or relationship with any senior officers employed
by the council directly or on an interim basis? If they did, was a
potential conflict of interest declared to the council's monitoring
officer? If it was, when was the declaration recorded? Please provide
a copy of any declarations of this kind.

 

The Project Manager for the ‘Working Differently Project’ was appointed
with the full knowledge of Copeland Directors in relation to his
connections and relationship with a Copeland Director. The matter was
declared and accepted on a short term basis in order to provide the
required skills and expertise to progress.

specialist outside agencies were be used to assist recruitment. CV’s
submitted were checked for the specialist skills and experience sought and
an appointment made by Chief Executive subsequently formally approved by
M.O.

 

4. Which directors were responsible for agreeing Mr Greenways daily rates
and signing off his invoices?

The daily rate paid to Outcome Delivery Consulting Ltd for S.Greenway was
£600.00 (plus VAT).

7. Please provide a copy of the declaration of interest mentioned in your

In June 2014 Mrs Rooney was engaged by Copeland BC as a consultant to be interim director of commercial and corporate resources which included responsibility for property and changes to accommodation https://www.whatdotheyknow.com/request/2.... Just before joining Copeland BC both worked together at North Tyneside Council where she was strategic director of finance and resources and he was a solicitor. The council were asked by Mr Dixon's FOI to provide details of Mr Greenway's qualifications and experience in property project management and have ignored the request. The answers to the FOI suggest Mr Greenway, a solicitor, was employed by Copeland as a property refurbishment expert on £600 a day and claim that he was chosen after considering other applicants. It seems strange that the Related Party Transactions in respect of interest in Company provided by Copeland in answer to Mr Dixon's FOI is dated 2017 and not 2014 when Mr Greenway started working for Copeland and that it makes no mention of Mrs Rooney's links with Outcome Delivery Consulting. Why couldn’t Copeland find an experienced and qualified property refurbishment expert for less than £600 a day? Whose CVs did they consider? Why was Mr Greenway's relationship with Mrs Rooney and her previous relationship with Outcome Delivery Consulting not declared and recorded when Mr Greenway started working for Copeland BC in August 2014?

Copeland BC say that Mr Greenway was paid through Outcome Delivery Consulting. Copeland BC transparency data shows that between 2014 and 2016 payments totalling over £300,000 were made to Outcome Delivery Consulting. There there must have been other council staff and consultants involved who were not paid by Outcome Delivery Consulting like Mr Greenway. The cost of refurbishing the Market Hall without consultant and other staff costs was £1,056,882 https://www.whatdotheyknow.com/request/c.... They denied it when responding to other FOIs but Copeland BC seem to have responded to Mr Dixons saying that Mr Greenway was responsible for project management. Copeland BC had previously put project management down to Mr Morton who used to be the councils estates and property manager. Mr Morton cannot comment after allegedly being paid a large sum of money to resign and asked to sign a non-disclosure agreement. Copeland BC have refused to answer Mr Youngs FOI questions on this but could have answered no if what Mr Young raised was not relevant. Instead they have admitted they hold information that they cannot release https://www.whatdotheyknow.com/request/m.... The response to Mr Dixons FOI says that the Market Hall refurbishment had a budget of £410,000. Looking at all FOIs on this subject there has been £1,000,000 overspend. Why so much and where did the extra money come from to complete the project?

CBC have released the current Grant Thornton audit report and this is available here:

They have also released their corresponding Letter of Representation here:

What is curious about these two documents is that while GT states: "Matters in relation to fraud - We have previously discussed the risk of fraud with the Chair of the Audit and Governance Committee and we have not been made aware of any incidents in the period. No other issues have been identified during the course of our audit procedures."

The CBC letter to GT states: "We have disclosed to you all our knowledge of fraud or suspected fraud affecting the Council involving: management; employees who have significant roles in internal control; or others where the fraud could have a material effect on the financial statements."

This is a highly irregular statement to be found in a letter of representation. Maybe some enterprising WDTK member who has had success getting replies to FOI's would like to ask CBC what they exactly mean by this, any why on one hand they appear to admit having knowledge of fraud, yet the GT report gives them a clean bill of health?.

Regarding the other matters, in respect of the amendment to the original
reply statement the reason provided was one of ‘clarity’ in that the
inclusion of the term, “in this instance” could have suggested that this
was an unusual incident or not normal procedure.  Removal of the words,
“in this instance”, was intended to indicate that nothing outside normal
procedure took place in the process.  I consider that the rest of your FOI
was responded to in full, but please let me know if you consider anything
else outstanding.

I am writing to request an internal review of Copeland Borough Council's
handling of my FOI request 'Cost to refurbish Market Hall in Whitehaven'.

I am interested in the reasons for your reluctance to answer my first FOI
and the reasons for not fully answering my second FOI. Following the
annotations to my second FOI I am interested to find out if your mayor and
directors and auditors have been asked to consider concerns raised and
what they have to say.

Dear Marissa Joyce,

Thank you for your partial response but I am still confused by the amendment and in any case the things I and people who have contacted me would like comments on are:

1. Are CEO directors and mayor happy that specialist outside agencies were used to assist in recruitment when Stephen Greenway was appointed how many other CVs were considered because these will be held on record?
2. Mr Greenway is a solicitor and was recruited as a property expert so what specialist skills and experience did he have and what specialist skills and experience were in the other CVs because I was not given an answer to this FOI question?
3. Are CEO directors and mayor happy that Mr Paul Walker made the appointment and the MO formally approved it?
4. Are CEO directors and mayor happy that Mrs Rooney did not make a declaration of interest until 2017 and that it didn’t mention her previous relationship with Outcome Delivery who are the company that employed her husband on £600 a day and a partner of Campmuir Consulting?
5. Are CEO directors and mayor happy that there was a million pound overspend on the Market Hall and where extra money came from?
6. Are CEO directors and mayor happy that Martyn Morton was paid a large sum of money to resign and how much was he paid because this is public money and I do not think Mr Clifford Walker should have refused to answer a previous FOI on this? Are CEO directors and mayor happy that Martyn Morton was asked to sign a non disclosure agreement and why was he asked to sign one if he was paid a large sum of money when he resigned from being property manager?

Firstly, it may be helpful if I explain the remit of the FOIA. Anyone can request copies of information that a public authority already holds in a recorded form, but the FOIA does not oblige a public authority to create new information to answer questions; nor does it require a public authority to give advice, opinion or explanation in relation to issues/policies under question.

Regarding your FOI 6734/18 you state you "are interested to find out if your mayor and directors and auditors have been asked to consider concerns raised and what they have to say". As in questions 1,3,4,5 and 6 in your latest request below, you are asking for opinion.

If you would like to resubmit these questions as a new FOI request detailing exactly what recorded information you require, the Council will be happy to accept such a request.

In response to question 2 below, Stephen Greenway was appointed as sub contractor because of his legal background to assist with our PFI and other legal matters pertaining to the Working Differently project. The Council hold no record of the specialist skills and CV’S of others who may have been considered for the position.

The Council makes every effort to make sure that the services it provides are as efficient and effective as possible, and this includes any requests under the Freedom of Information Act. We now consider the review of your FOI request closed but if you believe that your request has not been dealt with satisfactorily, you may refer the matter to the Information Commissioner’s Office -
