Cost of managing asbestos in schools

Under the Freedom of Information Act 2000, please provide me with the following information:
1. the amount of money spent on asbestos management in schools between 2006 and 2016 (to include the costs of surveys, staff training and work to enclose asbestos within schools)
2. the amount of money spent on asbestos removal from schools between 2006 and 2016
3. the amount of money spent on fines for breaches in the safe management of asbestos in schools between 2006 and 2016
4. funding sought from the Department of Education and the Education Funding Authority for the management and removal of asbestos from schools between 2006 and 2016
5. the amount of funding approved by the Department of Education and the Education Funding Authority for the management and removal of asbestos from schools between 2006 and 2016
6. the projected budget for future management of asbestos in schools between 2017 and 2027

I understand that under the Act I am entitled to a response within 20 working days of your receipt of this request. Some parts of the request may be easier to answer than others. Should this be the case, I request that you release information as soon as possible.

Cost of Asbestos Management in Schools

Thank you for your request for information dated 05/09/2017 concerning
Asbestos in Schools

 

This is to inform you that your request has been considered and I can
provide the following response:

 

The Request:

 

Under the Freedom of Information Act 2000, please provide me with the
following information:

1.    the amount of money spent on asbestos management in schools between
2006 and 2016 (to include the costs of surveys, staff training and work to
enclose asbestos within schools) - There is no specific budget or account
code for asbestos management works, they would be paid for either by a
school (for small scale works such as labelling or possibly encapsulation)
or by the schools service and depending on the scale of the work would
depend on which budget was used.  These budgets have a broad remit and
would not be used solely for asbestos management.   To identify the amount
of money spent would require us to cross reference any corporate asbestos
paperwork with the financial ledger to determine whether it was spent on
schools.  This would exceed the 18 hours cost allowance.

Section 17 of the Freedom of Information Act 2000 requires Powys County
Council, when refusing to provide such information (because the
information is exempt) to provide you the applicant with a notice which:

(a)  states that fact;

(b)  specifies the exemption in question and

(c)  states (if that would not otherwise be apparent) why the exemption
applies.

In this instance the relevant exemption is Section 12 of the Freedom of
Information Act.

Section 12 of the Freedom of Information Act 2000 makes provision for
public authorities to refuse requests for information where the cost of
dealing with them would exceed the appropriate limit, as detailed in the
Freedom of Information (Fees and Appropriate limit) Regulations 2004.

The limit for public authorities is set at £450 which amounts to a maximum
of 18 hours of search and retrieval time charged at £25.00 per person per
hour.

The Regulations set out what may be taken into account when public
authorities are estimating whether the appropriate limit has been
exceeded. The costs are limited to those that an authority reasonably
expects to incur in:

·         determining whether it holds the information requested

·         locating the information or documents containing the information

·         retrieving such information or documents

·         extracting the information from the document containing it
(including editing or reformatting information)

 

We are therefore not obliged to provide a response to this part of  your
request, as the time required for officers to locate, retrieve and extract
the data from information held would exceed the appropriate limit.

In accordance with Section 12 of the Freedom of Information Act 2000 I am
unable to provide you with the details you have requested.

 

2. the amount of money spent on asbestos removal from schools between 2006
and 2016 See response above.

3. the amount of money spent on fines for breaches in the safe management
of asbestos in schools between 2006 and 2016 None

4. funding sought from the Department of Education and the Education
Funding Authority for the management and removal of asbestos from schools
between 2006 and 2016 These are English departments therefore no
information is held

5. the amount of funding approved by the Department of Education and the
Education Funding Authority for the management and removal of asbestos
from schools between 2006 and 2016 see above response

6. the projected budget for future management of asbestos in schools
between 2017 and 2027  - There is no specific budget for asbestos
management works, they would be paid for either by a school (for small
scale works such as labelling or possibly encapsulation) or by the schools
service and depending on the scale of the work would depend on which
budget was used.  But again, these are budgets with a broad remit and
would not be used solely for asbestos management.  

 

We believe that this request is now complete and shall be closed
immediately. Should any further information be requested regarding this
