3. the amount of money spent on fines for breaches in the safe management of asbestos in schools between 2006 and 2016
4. funding sought from the Department of Education and the Education Funding Authority for the management and removal of asbestos from schools between 2006 and 2016
5. the amount of funding approved by the Department of Education and the Education Funding Authority for the management and removal of asbestos from schools between 2006 and 2016
6. the projected budget for future management of asbestos in schools between 2017 and 2027

I understand that under the Act I am entitled to a response within 20 working days of your receipt of this request. Some parts of the request may be easier to answer than others. Should this be the case, I request that you release information as soon as possible.

We are unable to provide you with the information requested in questions
1. and 2. above.  Please refer to the legal appendix below for our

Appendix 1

 

Detailed legal reasoning for refusal

 

Section 12: Exceeds the appropriate limit

 

We consider that it would exceed the appropriate limit, as specified in
the Freedom of Information and Data Protection (Appropriate Limit and
Fees) Regulations 2004; therefore section 12(1) of the Act applies.

 

The appropriate limit has been set at £450 and may include working hours
of any person acting on our behalf at a rate of £25 per hour. This equates
to 18 hours to locate and extract the relevant information.

 

The amount of money spent on asbestos management or the removal carried
out by the Housing & Regeneration Department is not held in an easily
retrievable format.   There are approximately 86 schools in Wandsworth and
in order to ascertain which ones have had any asbestos works carried out
and then to identify costs would take over 18 hours.  This is because
records for each school will have to be retrieved and individually
reviewed.  We estimate this will take approximately 1 hour per school
meaning it would a minimum of 86 hours.

 

In accordance with the Freedom of Information Act 2000 this letter acts as
a Refusal Notice.

 

You may wish to narrow the scope of your request in order to try and bring
it within the cost limit.

 

You have the right of appeal against the refusal. If you wish to appeal
