Your request has been considered in accordance with the requirements of
the Freedom of Information (FOI) Act and our information access policy.

 

Unfortunately, to provide the information you have requested would exceed
the ‘appropriate limit’ of £450 set by the Freedom of Information
(Appropriate Limit and Fees) Regulations 2004.

 

Under section 12 of the FOI Act, we are not obliged to comply with a
request if we estimate that the cost of determining whether we hold the
information, locating and retrieving it and extracting it from other
information would exceed the appropriate limit. This is calculated at £25
per hour for every hour spent on the activities described.

 

We have estimated that it would greatly exceed the prescribed limit to
provide a response to your current request. This is because it is
estimated that it would significantly exceed the 18 hour limit to retrieve
and compile the information you have requested. To illustrate the extent
of information requested, from 2010 to 2014, we have 22 contractor years
worth of data, 27 audits and 324 monthly evaluations.

 

To help bring the cost of responding to your request within the £450
limit, you may wish to consider narrowing its scope so that we can more

You are in breach of the law; the data nor a valid response was not forthcoming within 20 working days.

That it has taken you in excess of this period to determine an ‘estimate’ that it would greatly exceed the prescribed limit to provide a response to my current request is unacceptable.

Why were you unable to determine this in the prescribed time period?

You state ‘from 2010 to 2014, we have 22 contractor years worth of data, 27 audits and 324 monthly evaluations’ but fail to explain how the 5 year period equates to ’22 contractor years’. It is appears the intention is to create an exaggerated situation and confuse.

Please provide the 27 audits. These must surely be readily available as I would expect them to be compared annually to access improvement or reduction of service.

Please advise when these reports will be provided; having identified their existence, it seems the response could be by return.

Please provide all information relating to the contractor, understood to be Enterprise Mouchel unless this is the sole contractor for the period – you have failed to identify the contractors or otherwise assist me to reduce the data being sought.

I was concerned that my request may be too specific yet it resulted in data being supplied from 2009 to May 2014; not dissimilar to the period about which you have asked for information.
My understanding is that the current TFL contractor has been used for a few years, at least dating to 06/2012.
Unconnected with your enquiry and mine of TFL, I have received information about the current (as at 2012) contractor which may be of interest to you. This relates to concerns that have arisen about staff costs.
Possibly, to avoid the what appears to be obfuscation and obstruction, you should restrict your request to the current contractor and the audits since they were appointed. As you state, logic suggests that the audits would be readily available, if only for year upon year comparison purposes.

I am contacting you regarding the internal review of your request for
information concerning contractor claims.

 

This review has been carried out by an independent panel following your
email of 5 May 2015 regarding the handling of you Freedom of Information
request. Please accept my apologies for the delay in providing you with an
outcome to your internal review request.

 

It has taken several discussions with key individuals for the panel to
establish what errors occurred in the handling of your original FOI
request (FOI-2064-1415) and to agree an appropriate course of remedial
action.

 

Firstly, after reviewing all the information held in relation to your FOI
request of 17 March 2015, the panel agree that in failing to provide you
with a response to your original request of 17 March within 20 working
days, TfL has breached the requirements of section 10 of the Act. The
panel also agree that your request in the first instance was not handled
in the correct manner and it should have been established from an early
stage that further clarification was required from yourself in order to
better understand the specific information you wanted. When this was
raised some two weeks after your initial request was received, no advise
or assistance was given to you so you could better understand what
information we hold in relation to contractor claims and in what format we
hold it.

 

It is clear that in failing to provide this advise to you TfL has breached
the requirements of section 16 of the Act where by it is a public
authority’s duty to provide advice and assistance to both prospective and
actual applicants for information. This duty potentially applies to most,
if not all, stages of the request process under the Act. The provision of
advice and assistance is how a public authority interacts with an
applicant in order to discover what it is that the applicant wants and,
where possible, assist them in obtaining this. On behalf of TfL, please
accept my sincere apologies for the shortcomings in the handling of your
request.

 

Secondly, due to the above the panel concluded that the section 12 cost
limit exemption applied to FOI-2064-1415 was based on an interpretation of
what information you sought from us.  However, although the original
estimated cost of trying to provide the information you sought in your
email of 17 March and subsequent email of 13 April may have been based on
our interpretation, the panel believe that the appropriate limit exemption
is still engaged in relation to FOI-2064-1415 as to try and provide
information in response to your request still would have exceeded the
appropriate 18 hour limit.

 

However, in order to address the above issues the panel asked the
appropriate team to provide a description of what information they hold in
relation to contractor claims and how is it held by TfL. Below are 3
points describing what information we hold:

 

o Claims made against TfL by third parties for damages/injuries. We hold
data on these dating back about 10 years and this is readily available
o Claims by TfL for damage to the network/assets by 3^rd parties. We do
split these by under/over £10,000. The data for this comes from two
sources and all of it is held electronically. However some of the
information will be harder to extract than others as it will depend on
the level of complexity required for the analysis, this could raise
issues with staff time and resource within the 18 hour appropriate
limit.
o Maintaining the Highways refers to our revenue budgets – i.e. cost of
maintenance – however these are not termed as claims as we pay for
these through the contract either via a lump sum payment or per order
but costs are not claimed for after the works are done without TfL’s
consent. This data is readily available however if complex analyse is
required this could raise issues with staff time and resource within
the 18 hour appropriate cost limit.

Regarding the 27 audits you subsequently asked for in your email of 5 May,
it was established during the panels review that the figure provided to
you was incorrect and that for the period you requested there are actually
15 audits held. These audits are held in electronic format but contain
vast amounts of audit information other than just claims and some may not
contain any claim information at all. To ascertain whether they hold any
claim information would require manual investigation which again could
raise issues with staff time and resource within the 18 appropriate limit.

 

The panel agree that at this point the most effect way forward would be
if, using the information described above, you would be willing to clarify
specifically the information you require and a new request be initiated.

 

Therefore in summary, the panel have upheld your complaint that TfL were
in breach of the Act by failing to provide a response within a 20 working
day period and by failing to provide adequate advise and assistant to
enable you to better understand what information we do hold.

1. The audits of your supplier from 2011 to the present. It is the main audits I am seeking. Please provide what is readily available and identify what has been redacted, what sections.

2. a breakdown of all claims for damage to the network ./ assets over £10,000 to include:

b. the amount paid to the contractor i.e. what TFL agreed to pay the contractor.

It is unclear if you are advising that, with regard to the damage at ‘2’ and my request at ‘2b’, there is no separate accounting for ‘claims’, damage to the network / assets that would be other than in the ordinary course of business, an unexpected event.

3. Please provide a copy of the agreement that enables a contractor to act upon damage and claim payment from TFL. This may assist me to better understand the relationship and charging process.

4. Where lump sum and per-order costs occur, please provide these figures, if possible identifying which per-order costs relate to damage caused by 3rd parties.

5. Please could you also clarify how, if damage is caused and costs over £10,000 to repair, you can work out what you were charged and then get the money back if the sum is caught up in the lump-sum payment. Possibly it would assist to explain the difference between a lump sum payment and per order payment and the circumstances in which each is used.
