I am writing to request an internal review of Bradford City Council's handling of my FOI request 'Cost of Casual Staff, Temorary, Agency Staff and IR35 Consultants by Specific Service Area'.

The council despite holding the information in terms of appointments and recruitment systems have failed to supply the information requested.

They then have provided information I did not ask for in terms of Legal Services offsetting costs against expenditure they have incurred.

I also understand the response came from Chris Chapman who is actually the SIRO and therefore he should be fully conversant with his responsibilities in terms of FOI in a public authority.

I refer to your request dated 9 ^ September 2020 under the Freedom of
Information Act 2000 for an internal review of the Council’s handling of
your FOI request 'Cost of Casual Staff, Temporary, Agency Staff and IR35
Consultants by Specific Service Area'.

 

In your review request you state:

 

·         The Council despite holding the information in terms of
appointments and recruitment systems have failed to supply the information
requested.

 

·         They then have provided information I did not ask for in terms
of Legal Services offsetting costs against expenditure they have incurred.

 

In reviewing the case I note the initial response advised:

 

“Please note it has not been possible to provide details in respect of
temporary contracts as these are not identified separately. Also due to
reasons both of confidentiality (personal and commercial) and that cost of
the time that would be required to collate such information would be
excessive, details of the individual people/posts involved have not been
supplied.”

 

Upon review I believe it is wholly appropriate to withhold the requested
information which contains wholly personal information relating to persons
other than yourself, the applicant. Section 40 (2) & (3) of the Freedom of
Information Act 2000 provides an absolute exemption where disclosure of
information would lead to a breach of the principles laid down by the Data
Protection Act 2018.

 

I consider the disclosure of the information which you requested would
constitute unfair processing in contravention of the first data protection
principle because those individuals whose personal data has been withheld
would not have had any reasonable expectation that it would be disclosed
in these circumstances.

 

The original response sought to provide a response at a level that would
not breach these principles, whilst also providing a response at a
corporate level in line with the spirit of the Freedom of Information
request. I therefore conclude the original response was appropriate
against the principles of the Data Protection Act 2018. 

 

In accordance with the Freedom of Information Act, if you are still not
satisfied with the outcome of the internal review you have the right of
appeal to the Information Commissioner who can be contacted at:
