Dear Information Officer,

Please can you explain to me why this request for information is being ignored?

I believe that information requests must be answered promptly and the law is being broken if the request is not actioned within 20 working days. This period ended on the 8 August 2017. Despite a reminder I am still waiting with the only response being a computer generated reply stating that I will be answered within another 20 days.

As mentioned in my previous reminder, the answer to this FOI/EIR request is urgently needed as it could effect a legal document that is required by a deadline.

I request that an internal review is conducted regarding the manner that this request has been dealt with and that a response is actioned without further delay.

Does this mean that the document is not held or that you cannot find the reference to it in the report?

You state that you are unable to find reference to the requested document in the draft coffey2 report.

It is cited as source information at section 2 at the final paragraph. Third line on page 2 of the letter report dated 5 March 2015.

I appreciate that I accidentally quoted the wrong date for the document by one day however you have accepted that the date should have read 25 september 2014.

It has now been well over a month since you promised that the request would be processed and you were fully aware that I had asked for this information request to be actioned as a matter of great urgency due to the closure date for tribunal papers.

I am currently waiting for guidance from senior officers and will respond
as soon as possible.
 
Review
 
As you are aware Hastings Borough Council appealed a decision by the
Information Commissioner (ICO) who ordered Hastings Borough Council to
release the Coffey 2 report.  This appeal has taken up a substantial
amount of officer time and unfortunately there has been a delay in
carrying out your requested internal review.
My email dated 22 December 2017 advised that I was waiting for guidance
from senior officers as it was possible that the release of the requested
information may jeopardise the appeal process.
I can confirm that senior officers have decided that this is not the case,
therefore please find attached the requested information (please note:
names have been redacted as these fall under Section 40(2) of the Freedom
of Information Act, this is an absolute exemption and will not be
disclosed).
If you remain dissatisfied then you may complain to the Information
Commissioners Office (ICO) who will decide whether the Council has handled
your request correctly.
