You tell me that Chichester District Council may hold this correspondence because "National Park Planning
functions in the area referred to in your request are delivered by Chichester District Council on behalf of the National Park Authority".

This is why I addressed my original FOI request to Chichester District Council, and it was they who told me that this was in your remit, that they did not hold correspondence and that I should address my request to you.

In fact, I know - for a fact, because I have a copy - that correspondence emanated from Shona Archer, in a letter dated 21 January 2016, under a letter heading "Chichester District Council, Working in Partnership [with the] South Downs National Park Authority" reference SDNP/15/00463/COU. Ms Archer's email address is [email address].

As the letter was issued under the letterhead of yourselves and Chichester jointly, I think it reasonable for me to assume that you BOTH have copies of this correspondence in your power or possession, and I therefore intend to pursue this, to the Information Commissioner if necessary, until I get it.

I have been copied into an exchange of emails relating to an FOI request
regarding a planning enforcement case: Land East of Mere Barn, Lynchmere,
GU27 3NG.
 
I am the case officer for this matter and I  have visited the location of
the dog training events the subject of this complaint. I now write to
enquire whether I can assist with your FOI request as a degree of
confusion appears to have arisen in this matter.
 
Planning responsibilities are carried out by Chichester District Council
on an agency arrangement. The Park is the planning authority for that part
of the South Downs National Park within the administrative district of
Chichester. Because of this working relationship, correspondence carries
the logos of both Chichester and the South Downs National Park but it is
the enforcement service at Chichester who has responsibility for
investigating breaches of planning control.
 
Please let me know what request has been made for information and I will
endeavour to resolve this matter for you. I have informed the Park
Authority of my intention to contact you directly. I hope that my email to

it. Some information has been redacted as it  is exempt under section 40
(personal information) of the Freedom of Information Act (FOIA), as the
information constitutes third party data. Section 40 (2) provides that
personal data about third parties is exempt information if one of the
conditions set out in section 40 (3) is satisfied.  Under the FOI Act
disclosure of this information would breach the fair processing principle
contained in the Data Protection Act (DPA), where it would be unfair to
that person / is confidential.  (There may be other reasons why the DPA
would be breached).

 

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review.  Internal review requests should be
submitted within two months of the date of receipt of the response to your

I can confirm that we have had no correspondence because the land is
within the South Downs National Park so is now within the remit of the
South Downs National Park Authority rather than ourselves.
