When you can expect to receive a response to your FOI request

 

Under the Freedom of Information Act 2000 the Council has a legal
obligation to respond to your request no later than 20 working days
following the date of receipt. Wherever possible, a response to your FOI
request will be sent to you before the legal deadline of 20 working days.

Brighton & Hove City Council confirms that it does hold information
covered by your request.
 
It has been identified that the exemption specified in Section 36 of FOIA
apply to this information. That exemption provides a qualified exemption
from disclosure where, amongst things, in the reasonable opinion of a
qualified person, disclosure would or would be likely to:
 
* Prejudice collective responsibility;
* Inhibit the free and frank provision of advice or exchange of views, or
* Otherwise prejudice the effective conduct of public affairs.
 
The exemption is subject to the public interest test. It is therefore
necessary for Brighton & Hove City Council to carry out a public interest
test: an exercise which involves balancing the public interest in
disclosing the information against the public interest in withholding it.
 
The Freedom of Information Act 2000 obliges us to respond to requests
promptly, and in any case no later than 20 working days after receiving
your request. However, we now need further time in which to consider the
public interest in disclosing the information.
 
We estimate that it will take an additional 20 days to take a decision on
where the balance of the public interest lies. Therefore, we will respond
to you by 25 March 2020.
 
 
If you are dissatisfied with the handling of your request, you have the
right to ask for an Internal Review. Internal Review requests should be
submitted within two months of the date of receipt of the response to your
original request, as per ICO guidance
