Correspondence regarding Injury On Duty reviews

Dear Avon and Somerset Constabulary,

The recently appointed Chief Constable Andy Marsh has ultimate responsibility for correctly administering police pensions having taken on role of the Police Pension Authority as one of his many functions.

When Mr Marsh was appointed there was already an ongoing process in the Avon and Somerset Constabulary for reviewing Injury on Duty pensions. It would not be unreasonable to assume that Mr Marsh would seek clarification into that ongoing process ensuring that it was being conducted lawfully and fit for purpose.

To that end I seek copies of all documentation (email, reports, letters, emails, presentations) that have either been sent or received by Mr Marsh in relation to this matter. I would ask for all correspondence from the date that his appointment was confirmed, and not the date that he actually took up the post.

As Mr Kern, has played a large role in the process both before and after the appointment of Mr Marsh. I would also like all correspondence (as above) sent and received during the same time period, both internally and externally (i.e. to other forces)

I write in connection with your request for information dated 7^th May
under the Freedom of Information Act.

Specifically you asked:

We have undertaken a search and recovered 9 emails that are relevant to
your request. Some of the identified emails have been sent by IOD
pensioners or on their behalf, to Mr Kern concerning specific IOD reviews.
As such those emails are concerning identifiable individuals, who would
not have an expectation that their correspondence be published on the
Whatdotheyknow website, therefore those emails (6) constitute personal
information and has been exempt from disclosure. 

The exemption applicable to this is Section 40(2), third party personal
information. This is an Absolute exemption so therefore there is no
requirement to conduct a harm or public interest test. Any information is
exempt from disclosure under the Freedom of Information Act if it relates
to or is supplied by another individual and disclosure of that information
would contravene any of the principles of the 1998 Data Protection Act, in
this particular case, disclosure of this information would contravene
Principles 1 and 2 of the Act, whereby personal data shall be processed
fairly and lawfully and only obtained for one or more specified purpose or
purposes.

Please find attached the remaining 3 emails that have been identified.

Thank you for your reply to date.

My request was in two parts. In the first part of my request I asked whether you would provide me with all correspondence either from or to the Chief Constable, Mr Marsh. None of the documents you have supplied seem to have been sent or received by Mr Marsh.

Can you confirm that the first part of this request has been considered, and if your response is the same, can you confirm that Mr Marsh has not sent or received any communication regarding the process of Injury Pension reviews, which considering that he has vicarious liability as the Police Pension Authority I find surprising.
