Dear Independent Schools Inspectorate,

The Education (Independent School Standards) (England) Regulations 2010 (“ISSR”), as amended, set out the standards that independent schools must meet in operating and providing education.

In connection with the recent transfer of Bearwood College from Charity Number 285287 (Bearwood College Trustees) to Reddam House (Berkshire) Ltd (and other subsidiaries of Educas International), please provide any correspondence you hold in respect of

1. Any complaints received directly or via the DfE, Ofsted etc about the school
2. any concerns raised about compliance with ISSR, including to:
a. Part 5 : Premises and Accommodation at Schools, which includes the requirement to ensure “that the school premises and the accommodation and facilities provided therein are maintained to a standard such that, so far as is reasonably practicable, the health, safety and welfare of pupils”.
b. Part 6: Provision of information, which includes the provision of accurate information on the school’s website, particularly “where the proprietor is an individual, the proprietor’s full name, address for correspondence during both term-time and holidays and a telephone number or numbers on which the proprietor may be contacted at all times”, “where there is a governing body, the name and address for correspondence of its Chair”, as well as making available policies, procedures etc.
c. Part 7 : Handling of complaints, procedure, records, in particular the extent to which “a complaints procedure is drawn up and effectively implemented which deals with the handling of complaints from parents of pupils“.

Thank you for your message. 

 

I note ISI’s contention is not a public body.  At the same time  I understand the ISI is included on the WhatDoTheyKnow site due to its public responsibilities as the body approved for the purpose of inspection under Section 162A of the Education Act 2005, reporting to the Department for Education on the extent to which schools meet statutory requirements.

                                                                                                     

While ISI is not currently subject to the Freedom of Information Act 2000, the Government carried out a consultation, in 2011, on the scope of the Freedom of Information Act.  I understand the ISI fell within the scope of this consultation but did not, apparently, agree to be brought within the scope of the Act.    At the same time I note Ofsted falls within scope of the Act.

 

Meanwhile, I have emailed you on the address you gave in your message (and to [email address]) with details of my concerns.   However, please note this will leave unanswered the wider questions raised in my FOI request in respect of Bearwood College.

Dear Durell,

The ISI has public responsibilities as the body approved for the purpose of
inspection under Section 162A of the Education Act 2005 reporting to the Department for Education on the extent to which schools meet statutory requirements. You have explained that the ISI does not consider itself (unlike Ofsted) to be subject to the Freedom of Information Act 2000.

Nevertheless, I wonder if in the interests of transparency and openness you would kindly provide the information I requested, in particular with respect to any concerns raised about Bearwood College’s compliance with the ISSR, particularly the following sections of the Regulations:

Part 5 : Premises and Accommodation at Schools, which includes
